HomeMy WebLinkAboutOrd 2589 10/07/1975 II " ORDINANCE NO. 2589 I II II WHEREAS, the Zoning Board of Appeals of the Village of Motmt Prospect did II conduct a public hearing tmder Case No. 23-V-75 on August 28, 1975, at the I hour of 8:00 p.m., in the Mount Prospect Village Hall, pursuant to proper I legal notice; and I AN ORDINANCE GRANTING A HEIGHT VARIATION FOR PROPERrY LOCATED AT 1400 "EAST "CENTRA1ROAD, MOUNfPROSPECT ,ILLINOIS I I I Ii II WHEREAS the Zoning Board of Appeals of the Village of Mmmt Prospect heard testimo~y presented tmder Case No. 23-V-75 pe:tainin~ to a request. for a certain variation from the Motmt Prospect Zonmg Ordinance to perm t the erection of an antenna tower upon the subj ect property, which tower shall not exceed a total height of sixty (60') feet when measured from grade legally described as follows: That part of the East Half CD of the West Half (t) of the Southeast Quarter (i) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian described as follows: Commencing at a point on the East line of the West Half (t) of the East Half G) of the Southeast Quarter CD of said Section 35 which is 872.13 feet North of the Southeast corner of said West Half OJ of the East Half (i) of the Southeast Quarter (-1) of said Section 35; thence West at right angles to the East line of said West Half (t) of the East Half CD of the Southeast Quarter (i) of said Section 35 a distance of 820 feet to the point of beginning of the tract herein described; thence continu- ing West on said line 500.15 feet, more or less, to the West line of the East Half (!) of the West Half (!) of the Southeast Quarter (1) of said Section 35; thence South on said West line 863.07 feet to the Southwest corner of said East Half CD of the West Half G) of the Southeast Quarter (!) of said Section 35; thence East along the South line of said Section 35 a distance of 500.60 feet, more or less, to a point 820 feet West of the Southeast corner of the West Half CD of the East Half CD of the Southeast Quarter CD of said Section 35; thence North 866.52 feet, more or less, to the point of beginning, in Cook County, Illinois. Goelz Prospect Gardens, being a Subdivision of the West Half (!) of the West Half CD of the Southeast Quarter (:D, to- gether with the East Two-thirds (2/3) of the North Three-quarters (3/4) of the Northeast Quarter (t) of the Southwest Quarter CD of Section 35, Township 42 North, Range 11, East of the Third Princi- pal Meridian, in Cook County, Illinois; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did reconnnend to the President and Board of Trustees of the Village of MOtmt Prospect that the requested height variation be granted; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on September 9, 1975, and did consider the reconnnendations of the Zoning Board of Appeals under Case No. 23-V-75; and WHEREAS, the Building Committee has recommended that the President and Board of Trustees of the Village of MOtmt Prospect concur in the reconnnendations of the Zoning Board of Appeals to allow the height \ II p I variation requested under Case No. 23-V-75; and WHEREAS, the President and Board of Trustees of the Village of Motmt Prospec have detennined that the best interests of the Village of Mount Prospect wil be attained by the adoption of the following Ordinance regarding the subj ect property; I Ii II I I NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF 'IHE VILlAGE OF IDJNT PROSPECT, COOK COUNIY, ILLINOIS: SECTION ONE: That the following variation be and it is hereby granted for I the above described property which is the subject matter of Case No. 23-V-75: The tenns of the Mount Prospect Building Code are hereby varied so as to pennit the construction and erection of one tubular steel television receiving antenna tower upon the subject property. SECTION TWO: That the aforesaid variation will be valid and effective only upon the perfonllance and continuous maintenance with respect to the subject property of the following conditions and restrictions: (a) That the total height of the tower including the antenna attached to the top thereof shall not exceed sixty (60') feet when measured from grade with the further restriction that such tower and antenna shall consist of a thirty (30') foot high tower to be located upon an existing thirty (30') foot high gyIImasium roof located upon the subject property. (b) That the antenna to be located on the subj ect property shall in no way cause any interference with radio or television reception to any other properties within the corporate limits of the Village of Mount Prospect. Ii II I' i I , II Ii II I Ii I , SECTION 1HREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby directed to issue a building pennit for the subject tower in accordance with the variation and limitations herein set forth. SECTION FOUR: That the variation granted by this Ordinance shall be null and vOld and of no force and effect whatsoever tmless an application for a building penni t, pursuant to such variation and restrictions contained herei , is made and construction commenced within one (1) year of the date of this Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
