I II :1 I I I II I I WHEREAS. the Zoning Board of Appeals of the Vtllage of Mount Prospect did meet on i the 22nd day of May, 1975, at the hour of 8: 00 p.m. , at the Mount Prospect Village I Hall and did hear Case No. 17-V-75, pursuant to proper legal notice; and II WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did hear thi i request to expand and continue an existing nonconforming use by remodeling the en I tire second floor of the building located on the property commonly known as 302 East I Northwest Highway, Mount Prospect, Illinois; and. . WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recomm d I to the President and Board of Trustees of the Village of Mount Prospect the approval f this request under Case No. 17-V-75 for the reasons that: ORDINANCE NO. 2591 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 302 EAST NORTHWEST HIGHWAY, MOUNT PROSPECT, ILLINOIS (1) There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variation is not based exclusively upon a desire to make money; (3) The granting of this variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the neighborhood, since the exterior perimeters of the building will not be enlarged; and I 'I I (4) The proposed variation will not impair an adequate supply of light and air to adjacent property, substantially increase congestion in the public streets, or endanger the pUblic safety -- in that the second floor of this building is pre- sently composed of a 9-room dwelling unit and an office; and ! WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Pr s- I pect did meet on the 9th day of September, 1975, and did review the aforesaid Case I No. 17-V-75, and has recommended to the Board of Trustees of the Village of Mount Prospect that it concurs with the recommendation of the Zoning Board of Appeals with respect to Case No. 17-V-75; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests lof the Village of Mount Prospect; I INOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 17-V-75, bei legally described as follows: I, II r Lot One (1) in the resubdivision of Block Ten (10) in Busse & Wille's Resubdivision in Mount Prospect in the West Half (t) of Section 12, " Township 41 North, Range 11, East of the Third Principal Meridian , 'l in Cook County, Illinois, '.s currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B- (Business - Retail and Service) District, which zoning classification shall remain in ect subject to the variation granted herein: I ! That a variation to expand and maintain a dwelling unit above a commercial use be granted so that the petitioner may change the entire second floor of the building located on the subject property by remodeling it into a two (2) bedroom dwelling unit. ECTION TWO: That all requirements of the Mount Prospect Building and Zoning ode shall be applicable except the variation noted in SECTION ONE heretofore men- .oned. ECTION THREE: That the Director of Building and Zoning of the Village of Mount rospect is hereby authorized to issue a building permit for construction in accord- ce with the variation hereinbefore mentioned. ' ECTION FOUR: That the variation grante,d herein shall not be confused with a land I se variation nor with a special use permit, but shall only be construed as a variation lrom Section 14.107 of the Zoning Ordinance of the Village of Mount Prospect in order I 0 allow the expansiop. of a nonconforming use. I ECTION FIVE: That the variation granted by this Ordinance shall be null and void I nd of no force and effect whatsoever unless an application for a building permit pur- I uant to such variation is made and construction commenced within one (1) year of he date this said Ordinance becomes effective.
