YARD FEQUIREMENT VARIATIONS FOR PROPERTY LOCATED AT TI.IE SOlJTI-n\'EST COR1\ffiR OF MILBtJRN AVENUE AND lnLLIAM STREET, MOUNT PROSPECT, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of I'lount Prospect did conduct a public hearing on the 28th day of August, 1975, at the hour .)f 8:00 p.m., at the Mount Prospect Village Hall and did hear Case No. 35-V-75, pursuant to proper legal notice; and 'WHEREAS, the Zoning Board of Appeals of the Village of Hount Prospect did hear this request :Cor a front yard yariation as well as a rear yard variation to allow the petitioner to construct a single-family residence to a line ten feet (101) from the property line adjacent to MilbuTIl Avenue and to a line five feet (5') from the property line adjacent to the alley which residence shall be located on the lot legally described hereinbelow; and h'HEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommend to the President and Board of Trustees the approval of this request under Case No. 35-V-75 for the reasons that: (1) There is a practical difficulty and particular hardship on the petitioner; (2) TIle purpose of the variation is not based exclusively upon a desire to make money; (3) The conditions upon which the petition for these variations are based are unique in that the lot is trimlgular in shape and a corner lot, subject to having two (2) front yards and one rear yard; and (4) The granting of these variations will not be detrimental to the public or injurious to surround property in that it will not alter the essestial character of the locality, since the other corner lots at this intersection have similar setbacks. \~illRE4S, the Building Committee of the Board of Trustees of the Village of 1'.Iount Prospect did meet on October 8, 1975, and did review the aforesaid Case No. 35-V-75, and has recommended to the Board of Trustees of the Village of :r-:ount Prospect that it concurs with the recommendation of the Zoning Board of Appeals with respect to Case No. 35-V-75; and h'HEFEAS the President and Board of Trustees of the Village of Mount Prospect have concurred with the recommendation of the Zoning Board of I Appeals that the variations herein be granted; and . ',I. hHEREAS, the President and Board of Trustees of the Village of Monnt Prospect I have reviewed the matter herein and have determined that the same is in the , 'I best interests of the Village of Mount Prospect. SECI'ION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variations noted in SECT IO}; Olffi heretofore mentioned. SECTION 1HREE: That the Director of Building and Zoning of the Village of ~;ount Prospect is hereby authorized to issue a building permit for construction in accordance Kith the variations hereinbefore mentioned. SECIION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variations is made and construction corrrrr,enced wi thin one (1) year of the date this said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by lahT.
