ORDINANCE NO. 2616 AN ORDINANCE GRANTING A FRONT YARD REQUIREMENT VARIATION AND A FENCE VARIATION FOR PROPERTY COMMONLY KNOWN AS 1 NORTH ELMHURST AVENUE, MOUNT PROSPECT, ILLINOIS J1.vHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on "I the 26th day of February, 1976, at the hour of 8: 00 p.m. , in the Mount Prospect :~afety Building and did hear Case No. 7-V-76, pursuant to proper legal notice; and :\ 'WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this~ ~equest for a variation to allow the owner to construct a United States Postal Service ~ facility on a tract of land located within the B-3 (Business-Retail & Service) District, !Which District lies immediately adjacent to and across from a tract of land lying with- ~n the R-1 (Single Family Residence) District; and 'IVHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the ap- iproval of this request under Case No. 7-V-76; and i WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have 'boncurred with the recommendation of the Zoning Board of Appeals that the 'herein be granted; and , "I f}\THEREAS, the President and Board of Trustees of the Village of Mount Prospect have [reviewed the matter herein and have determined that the same is in the best interests pf the Village of Mount Prospect; j iNOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES 'I pF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: :"1 !~ECTION ONE: That the property being the subject matter of Case No. 7-V-76, be- [jng legally described as follows: " f ~ " :'1 The West 70 feet of Lots One to Nine inclusive in Block Three (3) in the Ernst Busse Addition to Mount Prospect, a Subdivision of the South 543 feet of the East Half 0) of the Southwest Quarter (-1) of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, :',i Ii H f:l ~: : ;1 ~ '; Ii:; ~is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as 113- 3 (Business-Retail & Service) District, which zoning classification shall remain lin effect subject to the variations granted herein: q ili H (a) That the yard abutting the frontmost lot line of the subject property adjacent to Elmhurst Avenue be recJuced to twenty-three feet six inches (23' 6"); and H :i! fi Ii ~ iii I n l! ~ ; n "' li ~ , Ii H n H !I n U ,,1 "J (b) That the five foot (5') maximum height requirement for fences be increased to six feet (6') so as to permit the use upon the subj ect property to be wholely surrounded by a six foot (6') high fence. !, l " :'j q n ~ECTION TWO: That all requirements of the Mount Prospect Building and Zoning !<bode shall be applicable except the variations noted in SECTION ONE heretofore ~entioned . ,', 1! !SECTION THREE: That this Ordinance shall be in full force and effect from and after ~ts passage, approval, ;~d publication in the manner provided by law.
