HomeMy WebLinkAboutOrd 2632 05/18/1976 ORDINANCE NO. 2632 ~ i ! ~ I, li ~ ~ WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet Ii on the 25th day of March, 1976, at the hour of 8: 00 p.m. , at the Public Safety Build1 ing and did hear Case No. 12-V-76, pursuant to proper legal notice; and AN ORDINANCE GRANTING A FRONT YARD VARIATION FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF MILBURN AVENUE AND EMERSON STREET VHIEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for a front yard variation to allow the petitioner to construct a single ~ family residence to within sixteen feet (16') of the property line adjacent to Milburnl Avenue on the lot legally described hereinbelow; and ! i! WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-l mend to the Building Committee of the Board of Trustees of the Village of Mount Pro$- peet the approval of this request under Case No. 12-V-76 for the reasons that: ! l (1) There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variation is not based exclusively upon a desire to make money; (3) The conditions upon which the petition for this variation is based are unique in that the lot is a corner lot, subject to have two (2) front yards; and (4) The granting of this variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount i! Prospect did conduct a public hearing on May 13,- 1976, and did review the recom-i mendations of the Zoning Board of Appeals in Case No. 12-V-76; and : WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount I Prospect have recommended that the Board of Trustees of the Village of Mount Prost" pect concur in the recommendations of the Zoning Board of Appeals under said Cas~ No. 12-V-76; and i . I WHEREAS, the President and Board of Trustees of the Village of Mount Prospect h~".!ve reviewed the matter herein and have determined that the same is in the best interefts of the Village of Mount Prospect; I ff NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTE~S OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: i ij SECTION ONE: That the property being the subject matter of Case No. 10-V-76, ~e- ing legally described as follows: ! ,Ii Lot 15 in Waldemar Krause's Addition to Mount Prospect, being a Subdivision in the East Half <-n of the Northwest Quarter G) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, ~ I ! I i ! .....~.,~. .....~._L~.._ ,'j fi H q ti ib currently zoned under the Zoning Ordinance of the Village of Mount Prospect 4s R-1 (Single Family Residence) District, which zoning classification shall re- ~ain in effect subject to the variation granted herein: i That the yard abutting the frontmost lot line of the subject property adjacent to Milburn Avenue be reduced to sixteen feet (16') , for the purpose of constructing a single family residence; and to twenty feet (20') , for the purpose of constructing a 2-car garage attached to the aforesaid single family residence by a breezeway structure -- the lo- cation of all such construction shall conform to the survey attached hereto and hereby made a part hereof as Exhibit I. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning i Code shall be applicable except the variation noted in SECTION ONE heretofore "plentioned. \SECTION THREE: That the Director of Building and Zoning of the Village of Mount i !prospect is hereby authorized to issue a building permit for construction is accord- pance with the variation hereinbefore mentioned. 'ijSECTION FOUR: That the variation granted by this Ordinance shall be null and voidi 11and of no force and effect whatsoever unless an application for a building permit puri !suant to such variation is made and construction-commenced within one (1) year of ithe date this said Ordinance becomes effective.
