HomeMy WebLinkAboutOrd 2643 07/06/1976 ,....,...'";-~r' ORDINANCE NO. 2643 AN ORDINANCE GRANTING VARIATIONS FOR SENIOR CITIZEN HOUSING TO BE LOCATED UPON HUNTINGTO:N COMMONS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect held a regular meeting on June 10, 1976, at the hour of 8:00 p.m. in the Public Safety Building pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear testimony presented under Case No. ZBA 27-V-76, pertaining to a request to vary the terms of the Zoning Ordinance of the Village of Mount Prospect by varying minimum apartment size and the minimum parking requirements for certain Senior Citizens housing; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recommended that the variations requested under Case No. ZBA 27-V-76 be allowed; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is for the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the variations authorized and granted in SECTION TWO hereinbelow are conditioned upon and shall be valid and effective only so long as: A. The use of the subject property is for housing for Senior Citizens, i.e., persons who have attained the age of sixty-two (62) years; B. The construction of the subject property will meet the requirements set forth by the Department of Housing and Urban Development as well as Section 8 of the "United States Housing Act of 1937", as amended; C. The construction of the Senior Citizens facility contemplated herein shall be located as shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit I; with the maximum number to two hundred fourteen (214) units comprised of efficiency units, I-bedroom and 2-bedroom units laid out substantially the same as shown upon the floor plans for such units, attached hereto and hereby made aprt hereof as Exhibit II; and that such units will be leased through a twenty (20) year through forty (40) year agree- ments with the Department of Housing and Urban Development to persons at least sixty-two (62) years old, or physically handicapped, pursuant to the prospectus attached hereto and hereby made a part hereof as exhibit III; and D. That the said variations granted in SECTION TWO hereinbelow shall not run with the land, but shall be limited to that period of time wherein the subject property is owned, operated, and maintained by KENROY, INC., the petitioner herein. That the mlnlmum floor area for dwelling units as set forth in subsection C of Section 14.1502 of the Zoning Ordinance of the Village of Mount Prospect be reduced so as to allow a minimum floor area of 572 sq. ft. to be located upon the above described property. B. That the minimum parking requirement of the Zoning Ordinance of the Village of Mount Prospect be reduced so that the construction of the building contemplated for the land described above shall provide a minimum number of nine feet by nineteen feet (9' x 19') "parking spaces for automobiles equal to at least one such parking space for each dwelling unit constructed thereon. SECTION THREE: That all the requirements of the Zoning Ordinance of the Village of Mount Prospect be applicable except that variation set out in SECTION TWO hereinabove and any such requirement which may be construed to be in conflict with the limitation set forth in SECTION ONE hereinabove. SECTION FOUR: That the Director of Building and Zoning of the Village of Mount Prospect is hereby directed to issue a building permit in accordance with the variation and limitation herein- before mentioned. SECTION FIVE: That the variation granted by the Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date said Ordinance becomes effective. SECTION SIX: That the Village Clerk shall and he is hereby authorized to record, at the petitioner's expense, a certified copy of this Ordinance with the Cook County Recorder of Deeds -3- and/or the Registrar of Titles of Cook County, Illinois, as the case may be. SECTION SEVEN: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. AYES: 6 ! i ! I ! t ~ I I I , I I !
