HomeMy WebLinkAboutOrd 2556 02/18/1975 J ORDINANCE NO. :2 551:, AN ORDINANCE GRANTING A FRONT YARD REQUIREMENT VARIATION FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF FOREST AVENUE AND THAYER STREET, MOUNT PROSPECT, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did me~t on the 21st day of November, 1974, at the hour of 8: 00 p.m., at the Mount Prospect Village Hall and did hear Case No. 48-V-74, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for a front yard variation to allow the petitioner to construct a single family residence to within sixteen feet and 66/100 inches (16"66/100") of the pro- perty lot line adjacent to Thayer Street; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recprr mend to the President and Board of Trustees of the Village of Mount Prospect thie approval of this request under Case No. 48-V-74 for the reasons that: ' (1) There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variation is not based exclu- sively upon a desire to make money; (3) The conditions upon which the petition for this variation is based are unique in that the lot is a corner lot, subject to having two (2) front yards; and (4) The granting of this variation will not be detri- mental to the public or injurious to surrounding property in that it will not alter the. essential character of the locality; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mou(nt Prospect have reviewed the recommendations of the Zoning Board of Appeals and:: hi recommended that the Board of Trustees of the Village of Mount Prospect concur 'Iin the recommendations of the Zoning Board of Appeals; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect ' have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: [,SECTION ONE: That the property being the subject matter of Case No. 48-V-74 ~being legally described as follows: J "'--- Lot 22 in Block 20 in Prospect Manor, being a subdivision of part of the South. 3/4 of the West 1/2 of the West 1/2 of Sec- tion 34, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County.
