Robert Maddox, representing the Northwest Assembly of God Church (hereinafter referred to as Petitioner), has filed an application for variations for property located at 900 North Wolf road (hereinafter referred to as Subject Property), legally described as follows: Lot 1 in Subdivision of the Northwest Assembly of God Church, being the east 300 feet of the south 530 feet, as measured on the south and east lines thereof, of the southeast quarter of Section 26, township 42 North, Range 11 East of the third Principal Meridian (Excepting from said Lot 1 that part taken for road purposes, in Cook County, Illinois also The north 480 feet of the south 530 feet as measured on the east line thereof (except the west 228.20 feet thereof and except the east 300 feet thereof, as measured on the south line thereof) of the east half of the southeast quarter of Section 26, Township 42 North, Range 11 East of the third Principal Meridian, Cook County, Illinois; and WHEREAS, Petitioner requests variations from Section 14.805. B.2 to allow a front building setback of thirty nine feet (39') instead of the required forty feet (40') for the existing church building and to allow a sideyard setback of twelve feet (12') rather than the required twenty five feet (25') for the existing parking lot located west of the church building only; and WHEREAS, a public hearing was held on the variation being the subject of ZBA Case No. 20-96 before the Zoning Board of Appeals of the Village of Mount Prospect on the 14th day of November, 1996, pursuant to due and proper notice thereof published in the Mount Prospect Journal and Topics on the 30th day of October, 1996; and VVHEREAS, the Zoning Board of Appeals did consider the requests stated herein and have forwarded their recommendation to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect has given consideration to the requests being the subject of ZBA Case No. 20-96 and have determined that granting these requests would be in the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant a variation from Section 14.805. B.2 to allow a front building setback of thirty nine feet (39') instead of the required forty feet (40') for the existing church building and to allow a twelve feet (12') extedor side yard setback for the parking lot west of the church building, rather than the required twenty five feet (25'), all as shown on the Site Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit 'W'. SECTION THREE: Except for the variations granted herein all other applicable Village of BA 20-96 Variations Page 2 of 2 Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
