ORDINANCE NO. 3222
AN ORDINANCE TO AMEND CHAPTER 14 ENTITLED "ZONING" OF THE
VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS REGARDING THE
ADDITION OF DAY CARE CENTERS AS A SPECIAL USE IN THE R-l
SINGLE FAMILY RESIDENCE DISTRICT
WHEREAS, the Board of Education of School District Number 57,
Cook County, Illinois, for whose use and benefit the Sunset Park
School Property in the 600 block of West Lonnquist Boulevard is
owned, and Allen and Lydia Schneider, prospective tenants of a
portion of said school property, have hereto filed an application
seeking an amendment to Chapter 14, commonly known as the "Zoning
Ordinance" of the Village Code of Mount Prospect, Illinois, to
provide for a Day Care Center for children between the ages of 2 and
5, when located in a public school building as a special use in an
R-l Single Family Residence District; and
WHEREAS, a public hearing was held on said zoning amendment
request (designated as Case No. ZBA-14-A-82) before the Zoning Board
of Appeals of the Village of Mount Prospect on the 20th day of May,
1982 pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 3rd day of May, 1982; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and reco~mendations to the Board of Trustees of the Village of Mount
Prospect; and
WHEREAS, the President and Board of Trustees have considered
further the application and the findings and recommendations of the
Zoning Board of Appeals and have determined that it is in the best
interest of the community to grant the amendment request.
NOW, THEREFORE, BE IT ORDAINED BY THE PRES IDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: Chapter 14 entitled "Zoning" of the Village Code
of Mount Prospect, Illinois, 1981, as amended is hereby further
amended as follows:
A. By amending Section 14.1l0lC entitled "Special Uses"
of Article XI entitled "R-l District" thereof to add
thereto an additional special use to read:
"Day Care Centers as defined in this Chapter,
when located in a Public School Building."
B. By amending subsection B of Section 14.2602 entitled
"Rules and Definitions" of Article XXVI thereof to add
thereto in proper alphabetical order the following
definition to read:
"DAY CARE CENTER - Any facility which regularly
provides essential personal care, protection,
supervision, training and programs to serve the
needs of more than eight (8) pre-school or
elementary school-age children, or both, for
periods, including non-school hours, of less than
24 hours per day."
SECTION TWO: This Ordinance shall be in full force and effect
f rom and af ter-- its passage, approval and publ i cation in pamphlet
form in accordance with law.
