ORDINANCE NO. 2668
AN ORDINANCE AUTHORIZING A VARIATION
FROM SECTION 21.1011 OF THE MOUNT PROSPECT
BUILDING CODE

I WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did meet on
I the 26th day of August. 1976. at the hour of 8: 00 p.m. . in the Public Safety Build-
ing. and did hear Case No. 45-V-76. pursuant to proper legal notice; and

WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect. pursuant
to authority vested in it under subsection E of Section 14.504 of the Municipal Code
of Mount Prospect of 1957. as amended. did hear this request to locate a central air
conditioning compressor in the side yard loctated at the northeast corner of the buil -
ing on the property commonly known as 203 North Stevenson Lane. Mount Prospect.
Illinois. and;
WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees of the Village of Mount Prospect the ap-
proval of this request under said Case No. 45-V-76 for the reason that location of
the compressor in the said side yard of this unique instance will be the least offen-
sive to neighbors; and
WHEREAS. the Building Committee of the Board of Trustees of the Village of Mount
Prospect did conduct a public hearing on the 14th day of October. 1976. and did re-
commend to the Board of Trustees of the Village of Mount Prospect the granting of
the requested variation under said Case No. 45-V-76; and
WHEREAS. the President and Board of Trustees of the Village of Mount Prospect hav
concurred with the recommendation of the Zoning Board of Appeals that the variatio
requested herein be granted; and
WHEREAS. the President and Board of Trustees of the Village of Mount Prospect hav
reviewed the matter herein and have determined that the same is in the best interest
of the Village of Mount Prospect;
NOW. THEREFORE. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEE
OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 45-V-76. be
ing legally described as follows:
Lot 71 in First Addition to Bluett's Fairview Gardens. being a sub-
division of part of the West Half (i) of the East Half (-D of the South-
east Quarter CD and part of the East Half (-D of the West Half <!) of
the Southeast Quarter (-!) of Section 35. Township 42 North. Range
11. East of the Third Principal Meridian. in Cook County. Illinois.
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
R-1 (Single Family Residence) District. which zoning classification shall remain
in effect subject to the variation granted herein.
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Codes shall be applicable except that Section 21.1011 of the Municipal Code of Mount
Prospect of 1957. as amended (Building Code) . shall not govern the placement of a
central air conditioning compressor to serve the home located upon the subject pro-
perty. and that the location of said compressor shall be that as shown upon the plan
attached hereto and hereby made a part hereof as Exhibit A.
SECTION THREE: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction in accord-
ance with the variation hereinabove granted.
SECTION FOUR: That the variation granted by this Ordinance shall be null and voi
and of no force and effect whatsoever unless an application for a building permit pu -
suant to such variation is made and construction commenced within one (1) year of
the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and after
its passage. approval. and publication in the manner provided by law.
