HomeMy WebLinkAboutOrd 2673 11/16/1976 ORDINANCE NO. 2673 AN ORDINANCE GRANTING A TRANSITIONAL YARD REQUIREMENT VARIATION FOR PROPERTY LOCATED AT 431 WEST DEMPSTER WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 2nd day of September, 1976, at the hour of 8: 00 p.m., at the Mount Prospect Public Safety Building Boardroon and did hear Case No. 59-V-76, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request to allow an increase in the density from 7.5 dwelling units, normally allowed for property zoned R-4, to 12 dwelling units upon the subject property; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommend to the President and Board of Trustees the approval of this request under said Case No. 59-V-76; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on the 11th day of November, 1976, and did consider the I recommendations of the Zoning Board of Appeals under said Case No. 59-V-76; and WHEREAS, the Building Committee has recommended that the President and Board of Trustees of the Village of Mount Prospect concur in the recommendations of the Zoning Board of Appeals to allow the variation requested under Case No. 59-V-76 but to reduced the number of dwelling units from 12 to 9; and I WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 59-V-76, being legally described as follows: I I That part of the East 840.40' of the North 20 acres of the North East quarter of the North East quarter of Section 23, Township 41 North, Range 11, East of the Third Principal Meridiari, described as follovvs: Beginning at a point on the North Line of Section 23 which is 740.40' West of the Northeast corner of said Section (as measured along the North line of said Section); thence South on a line parallel to the East line of said Section, 200'; thence west on a line parallel with the North line of said Section, 100'; thence North on a line parallel with the East line of said SectioI} ,200'; thence East along the North line of said Section laO' to the point of beginning in Township of Elk Grove, in Cook County, Illinois. I is currently zoned under the Zoning Ordinance of the Village of Mount Prospect I J I - - it:).. - as R-4 (Residential Development District), which zoning classification shall remain in effect subj ect to the variation granted herein: That the density for the subj act property be increased from 7.5 dwelling units to 9 multi-family dwelling units. SECTION TWO: That all-requirements of the Mount Prospect Building and Zoning Codes shall be applicable except the variation noted in SECTION ONE heretofore mentioned. SECTION FIVE: That this Ordinance shall be null and void and of no force and effect whatsoever until after its passage, approval, and publication, and such time as an accurate plat resubdividing the said parcel described in SECTION ONE hereinabove is recorded with the Recorder of Deeds of Cook County, Illinois; a copy of which plat of resubdivision shall be attached hereto and hereby _ made a part hereof.
