II I: I II Ii ~ i AN ORDINANCE GRANTING A TRANSITIONAL YARD REQUIREMENT VARIATION FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF MIDWAY DRIVE AND ELMHURST ROAD, MOUNT PROSPECT, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 23rd day of September, 1976, and on the 28th day of October, 1976, at the hour of 8: 00 o'clock p.m., at the Mount Prospect Public Safety Building Boardroom and did hear Case No. 49-V-76, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request to allow the petitioner to install motor vehicle parking spaces within the transitional yards adjacent to the building located upon the subject property; and I I WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- I mend to the President and Board of Trustees the approval of this request under sai Ca..<;e No. 49-V-76; and WHEREAS, the Building Committee has recommended that the President and Board of Trustees of the Village of Mount Prospect con.cur in the recommendations of the I Zoning Board of Appeals to allow the variation requested under said Case No. I 49-V-76; and I WHEREAS, the President and Board of Trustees of the Village of Mount Prospect i have determined that the same is in the best interests of the Village of Mount Prosp Ict I NOW, THEREFORE. Prospect is hereby authorized to issue a building permit for construction in accord I ance with the variation hereinbefore mentioned. . ! i SECTION FOUR: That the variation granted by this Ordinance shall be null and voJd ! and of no force and effect whatsoever unless an application for a building permit pu - suant to such variation is made and construction commenced within one (1) year of the date this said Ordinance becomes effective.
