HomeMy WebLinkAboutOrd 2709 04/26/1977 !I li Ii Ii ,I II !i Ii II 'I II !I I BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE I' I OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: I II ~ECTION ONE: That, pursuant to the authority vested in the President and Board I II of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu- I ,I 11,11.,1 tion of the State of Illinois, Section 4.801 of the Municipal Code of Mount Prospect I of 1957, as amended, be and the same is hereby further amended in its entirety by I III establishing exempt ranks within the Police Department of the Village of Mount Pros- pect; so that hereafter the said Section 4.801 shall be and read as follows: II II II I i, I " I i II A. I I I Ii 1. The head of said Department shall be the Chief of Police who sha~l II be appointed by the Village Manager foran indefinite period of tfme II 2. In addition to the Chief of Police. the Village Manager be and he ~s ,I hereby authorized to appoint, solely from the officers of the Mouflt I I Prospect Police Department upon the recommendation of the Chie I of Police, one (1) Deputy Chief of Police, two (2) Division Coro- I manders, and five (5) Watch Commanders. I I a. The Village Manager is hereby authorized to suspend or disr charge the Chief of Police. I i i [ b. The Village Manager, upon th~ recommendation of the Chieflof Police, is also hereby authorized to suspend or discharge afY or' all of the persons holding the following positions: D eputr Chief, Division Commander, and/or Watch Commander. I I c. In the event the Village Manager suspends or discharges anlv of the persons holding the position of Chief of Police, Depu.t Chief, Division Commander, and/or Watch Commander, sai person or persons shall revert to his or their permanent ra k, if any, in the Police Department as established under the Ill~- nois Board of Fire and Police Commissioners Act. I I B. All of the personnel of the said Police Department shall encompass such j members in Fire and Pollee Commission rank and number as may be pro I vided from time to time by Resolution of the President and Board of : Trustees. The power of appointment, discharge, or suspension of all I officers of the Police Department other than the Chief, Deputy Chief, I Division Commanders, and Watch Commanders established hereinabove" shalllie with the Board of Fire and Police Commissioners of the Village ! of Mount Prospect heretofore created and now acting pursuant to the I provisions of the Illinois Municipal Code. SECTION TWO: That, pursuant to the authority vested in the President and Board I of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu- ' tion of the State of Illinois, Section 4.803 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended by amending sub section F thereof in its entirety and by adding two (2) new subsections, G and H, to the listing of "Duties of the Chief of Police"; so that hereafter the said subsectio s F, G, and II shall be and read as follows: II F. He shall be and is hereby authorized to serve and/or cause to be served summons, subpoenae, and other processes; i i I II ,I II II II Ii II 11 I: :1 ISECTION THREE: That Chapter 6 of the Municipal Code of the Village of Mount ,~rospect of 1957, as amended, be and the same is hereby further amended in its I entirety in order that same may be held in reserve--all matters thereunder having I een amended and or adopted elsewhere in the Municipal Code; so that hereafter :he said Chapter 6 shall be and read as follows: . I I I I'SECTION FOUR: That this Ordinance shall be in full force and effect from al)d : fter its passage, approval, and publication in the manner provided by law. G. He shall make such rules and orders for the guidance of the mem- bel'S of the Police Department as he shall see fit; which rules and orders shall be binding upon the members of the said Department; and H. He shall perform such other duties as may be required of him from time to time by the Village Manager. " lTCHAPTER 6.
