[ AN ORDINANCE AUTHORIZING THE ACQUISITION OF CITIZENS UTILITIES COMPANY OF ILLINOIS SEWER a WATER SYSTEM LOCATED IN AND NEAR THE NORTHEAST SECTION OF THE VILLAGE OF HOUNT PROSPECT. v;nEREZ.."S, Section 6 (a) of Article VII of the 1970 Constitution of the state of Illinois provides that any municipality which has a population of more than 25,000 is a home rule u.nit, and the Village of 1-1ount Prospect, Cool( County, Illinois, with a popula- tion in excess of 25,000 is therefore a home rule unit and, pursuant to the provisions of said Section 6(a) of ]>~rt,icle VIr, may exercise any power and perform any function pertaining to its government and affairs, including, but not limited to, the power to tax and to incur debtj and vTrlEREAS I the presiden.t and Boa.rd of Trustees of the village of Haunt Prospect have heretofore on I L II Li, 19~, adopted Ordina.nce No. 9' t!J~ of MAY' . , the said Village authorizing the operation and main- tenance of a combined vJatenvorks and sewerage system vdthin the said Village and area.s con.tiguous thereto; a.nd 'W:8EREAS, Citizens utilities Company of Illinois O\'ffiS and operates a water and sewer system \vithin a. por- tion of the corporate limits of said Village, which system is generally known as Citizens utilities. Chicago Suburban Property, and which is more fully described in Figures 1 and 2 a.nd Schedules A, B, C, and D of this Ordinance, \vhich Figures and Schedules are attached hereto and incorporated herein by this reference; and \'V'IillREAS, ci tiz.ens utili ties Company of Illinois has, at various times, been granted certificates of public convenience and necessity by the Illinois Commerce Commission I I II to provide water and sewer se:::-vice as a public utility to por-. tions of the Village of Mount Prospect; and WdEREAS, Citizens Utilities Company of Illinois in and about the operation and maintenance of the aforesaid water public utility owns the personal property described in the aforesaid Schedule A, and in addition, possesses interests in certain real estate, which real estate is more fully described in Schedule B. The loc~tions of said real and personal property are shown in the aforesaid Figure 1; and ~r.dEREAS , Citizens Uti li ties COIi1pany of Illinois in and about the operation ~~d maintenance of aforesaid sewer public utility owns the personal property described in the aforesaid Schedule C, and in addition, possesses interests in certain real estate, which real estate is more fully described in Schedule D. The locations of said real and personal property are shOwn in the aforesaid Figure 2; I and ~mEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the water and sewer service provided by Citizens Utilities Company of IIllinois constitutes a IIcombined waterworks and sewerage I . jsystemll within the meaning of Illinois Revised Statutes 1(1975), Chapter 24, Section 11-139-1; and tVREREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the water land sewer service provided by Citizens Utilities Company of I Illinois has frequently been inadequate and unsatisfacto+y, nd has impeded the development and growth of the Village; and - 2 - I vlHEEEAS f under and by virtue of the Illinois 1-1uni- cipal Code, and In particular, Illinois Revised Statutes (1975), Chapter 24, Section 11-61-1 and Section 11-139-12, the Village of l'-1ount Prospect is authorized to exercise the right of eminent domain in condemnation proceedings to ac- quire property and combined waterworks and sewerage systems that are necessary for municipal purposes or public welfare; and miEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that it is necessary for the municipal. pu::::poses of the said Village, and the public welfare of the citizens thereof, that all of the property, both real and persona.l, of citizens utilities Company of Illinois, within the corporate limits of the said Village, together with all of the property, both real and personal, of said citizens utilities Company of Illinois loca.ted outside the corporate limits of the Village, but comlected to a.nd forming an integral pa.rt of the wa.ter supply and water distribution system and the sanitary sewer collection and treatment system located within the corporate limits of the Village of Hount Prospect be acquired by said Village, after paying to Citizens utilities Company ,of Illinois fa.ir and just compensation therefor; and that Ilafter such a.cquisition, the said systems be owned and oper- I ated by the Village as a municipal water and set,ver sy stemi .and I \Vh~REAS, the President and Board of Trustees of the Village of Moun.t Prospect desire to offer to purchase I!the sa id 'dater and sewer system of citizens utili ties Com- Ilpany of Illinois; and I - 3 - 1 II . SECTION SEVEN: In. the event the Village presi- ,dent, and I fnable to IIllinois the duly authorized agents of the Village, are reach an agreement with citizens Utilities Company on the amount of just compensation, then Messrs. Ross, Hardies, O.Keefe, Babcock & Parsons, attqrneys at law, upon the entry or affirr~.nce of a :einal order by the Illinois ommerce Commission approving condemnation of the said property of citizens Utilities Company of Illinois, be and they are ereby authorized to file all necessary petitions, complaints, and proceedings in the Circuit Court of Cook County, ~llinois, I Ito a.cquire the aforesaid water ~tilities Company of Illinois, and sewer system of citizens by the exericse of the power 10f eminent domain. SECTION EIGHT: The estimated cost of the acquisi- tion of the aforesaid water and sewer system is Thirteen Million Dollars. SECTION NINE: The estimated period of usefulness of the acquisition is perpetua.l, assuming the ordinary care, maintenance and replacement of capital equipment by the villa.ge. SECTION TEN: The costs of a.cquisi tion shall be Ipaid from the proceeds of revenue bonds to be issued at an 'nterest rate not to exceed seven per cent (7%) per annum. - 6 - ~/ SECTION ELEVEN: This Ordinance shall be in full force and effect from a.nd after its passage, approva.l and publication in the manner provided by law. The pump is I rated for 185 gpm (gallons per minute) at 292 feet TDH (total II I dynamic head). i of 130 feet. The pump is II rated for 1000 gpm at 803 TDH. The ilwel1 was drilled to a depth of 902 feet in 1960 but was I, abandoned by Citizens Utilities Company of Illinois in 1971 due to the decreased production of the well. The following reservoirs including 11 appurtenances, including, but not limited to, controls, nstrumentation, pipes and pumps at the following sites: Well No.2: A 1,250,000 Gallon Reservoir located djacent to Well site No.2, which is located on Euclid venue just west of Crabtree Lane. Well No.4: A 650,000 Gallon Reservoir located djacent to Well site No.4, which is located on the south- ast corner of Willow-Seminole Road and Burning Bush Lane. METERS. Approximately 3,946 residential and 66 omrnercial meters. Meters for single family residences are redominantly 5/8-inch units, and the various apartment com- lexes are metered by 5/B-inch to 6-inch units, depending on he nUTI~er of apartments served. I , I I II [I !I I I FORCE MAINS Force Main No.1: This force main conveys waste water between the Park Drive lift station and the wet well of the Willow-Seminole Road and Park Drive lift station. The force main consists of approximately 2,540 feet of 6-inch diameter, Class 150, cast iron pipe at an average depth of 8 feet. Force Main No.2: Force Main No.2 extends from the Park Drive and Willow-Seminole Road lift station to the Burning Bush and Willow-Seminole Road lift station. This force main consists of approximately 1,900 feet of 8-inch diameter, Class 150, cast iron pipe at an average depth of 8 feet. Force Main No.3: This force main is located between the lift station at Willow-Seminole Road and Burning Bush Lane and the }1SDGC interceptor in Wolf Road. The force main consists of approximately 1,950 feet of 12-inch diameter, Class 150, cast iron pipe and discharges into a 24-inch dia- meter V C P gravity sewer at Willow-Seminole Road and Mandel Lane. The 24-inch gravity sewer continues west along Willow- Seminole Road for about 620 feet before discharging into the 5-foot 9-inch diameter }1SDGS interceptor running south on Wolf Road. Force Main No.4: Force Main No. 4 was constructed in 1970 and consists of approximately 1,485 feet of 8-inch diameter, Class 150, cast iron pipe. This main extends from the Quince Park lift station to the connection with the 12- inch force main in Willow-Seminole Road just west of the lift station at Willow-Seminole Road and Burning Bush Lane. Approximately 84 per cent of the total sewer net- work is vitrified clay pipe (V C P). Reinforced concrete pipe and-asbestos cement pipe comprise the remaining 16 per cent of the system. Service connections to single family residences are 6-inch diameter V C P, while those to the various apartment complexes are either 6-inches or 8-inches in diameter. The Ikacility is a Smith and Loveless, prefabricated, underground ift station consisting of an 8-foot diameter pump chamber, --foot diameter entrance tube, and 6-foot diameter wet well. he base of the station is approximately 24 feet below grade. Holiday Inn Lift Station: The Holiday Inn lift tation is located near the Holiday Inn at Milwaukee Avenue lrnd Winkelman Road. The facility is a prefabricated, under- I . round lift station consisting of a 7-foot diameter pump hamber, 3-foot diameter entrance tube, and 5-foot diameter et well. The base of the station is approximately 16 feet elow grade. I J .C-4 ? Tex-Vit Lift Station: The Tex-Vit Lift Station lis located north of Boulder Drive and west of the Ivlinneapolis, St. Paul and Sault Ste. Marie Railroad tracks. The prefabri- cated, underground station was manufactured by the Tex-Vit Corp. and consists of a 12.5-foot long by 8-foot wide pump chamber, a 3-foot diameter entrance tube, and a 5-fbot diameter wet well.
