ORDINANCE NO. 2723 AN ORDINANCE AUTHORIZING A VARIATION FROM SECTION 21.1011 OF THE MOUNT PROSPECT BUILDING CODE ", i'YHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on I he 27th day of January, 1977 and the 24th day of February, 1977, at the hour of I : 00 p.m., in the Public Safety Building, an.d did hear Case No. I-V-77. pursuant , 0 proper legal notice; and !lvHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect. pursuant II Ito authority' vested in it under subsection E of Section 14.504 of the Municipal Code of ~l,rount Prospect, did hear this request to locate a central air con~~ti~ning compressor I n the front yard of the property commonly known as 100 South Wilham Street, Mount rospect, Illinois; and . ~II>lHEREAS' the Zoning Board of Appeals of the Village of Mount Prospect did recom- II. end to the President and Board of Trustees of the Village of Mount Prospect the . enial of this request under said Case No. 1-V-77; and ' VHEREAS, the Building Committee of the Board of Trustees of the Village of :Mount rospect did conduct a public hearing on June 6, 1977, and did recommend to the oard of Trustees of the Village of Mount Prospect the granting of the requested varia ion under said Case No. I-V-77; and II " HEREAS, the President and Board of Trustees of the Village of Mount Prospect have eviewed the matter herein and have determined that the same is in the best interests I f the Village of Mount Prospect; I OW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT A~l) BOARD OF TRUSTEES i' F THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: ECTION ONE: That the property being the subject matter of Case No. 1-V-77, eing legally described as follows: Lot 22 in Block 9 in Busse's Eastern Addition to Mount Prospect in the East half (1/2) of Section 12, Town 41, Range 11, East of the Third Principal Meridian. EeTiON TWO: That all requirements of the l\iount Prospect Building and Zoning odes shall be applicable except that Section 21.1011 of the Municipal Code of Taunt Prospect of 1957. as amended (Building Code), shall not govern the place- , lent of a central air conditioning compressor to serve the home located upon the ubject property. and that the location of said compressor shall be that as shown pon the plans attached hereto and hereby made a part hereof as Exhibit A. ECTION THREE: That the Director of Building and Zoning 0: the Village of Mount rospect is hereby authorized to issue a building permit for construction in ccordance with the variation hereinabove mentioned. ECTION FOUR: That the variation granted by this Ordinance shall be null and void nd of no force and effect whatsoever unless an application for a building permit ursuant to such variation is made and construction commenced within one (1) year f the date this said Ordinance becomes effective. ECTION FIVE: That this Ordinance shall be in full force and effect from and after s passage, approval and publication in the manner provided by law. I . ..
