AN ORDINANCE AMENDING SECTION 23.103
OF THE MUNICIPAL CODE

SECTION ONE: That, pursuant to the authority vested in the President and Board of'
I'Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitution of
the State of Illinois, Section 23.103 of Chapter 23 (Water & Sewer) of the Municipal
I Code of Mount Prospect of 1957, as amended, be and the same is hereby further
I amended in its entirety by eliminating the necessity of a user to make a cash deposit I
with the Village Treasurer for water service; so that hereafter the said Section 23.lOb
shall be and read as follows: r

BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
" SECTION 23.103. User. As utilized in this Chapter, "User" is hereby
defined as any of the following units to which water and sewer services
are provided by the Village of Mount Prospect:

A. Any single family residence;
B. Any single living unit located in any multi-family building, whether such
building is a duplex residence, a townhouse, an apartment building, a
condominium building, a cooperative building, or any other residential
or combination use building;
C . Any eleemosynary institution;
D. Each commercial use occupancy; and

IE. Each industrial use occupancy. "
I' SECTION TWO: That the Village Treasurer be and he is hereby directed to refund I
I any cash deposit for water service heretofore posted by any given user, pursuant to I
I' the terms of the former Section 23.103 of the said Municipal Code, which refund Shallj
be made to such user without interest.

A. Such refund may, at the discretion of the Village Treasurer, be created to
the current account of any such user; or refunded by warrant drawn upon
the Waterworks & Sewerage Fund of the Village of Mount Prospect.
B. Such refunds shall be accomplished during the regular-~ourse of business
within the procedures determined by the Finance Director of the Village of
Mount Prospect.
SECTION THREE: That this Ordinance shall be in full force and effect from and after
