HomeMy WebLinkAboutOrd 2759 12/06/1977 II "I I: II ;J q II I: 'I I I ':~I 2/,/7 ,:z;.~ ORDINANCE NO. 2759 AN ORDINANCE VACATING A PORTION OF ISABELLA STREET BETWEEN NORTHWEST HIGHWAY AND A POINT SOME 792 FEET El".lST THEREOF HEREAS , the Zoning Board of Appeals of the Village of Mount Prospect did conduct public hearing under Case No. 43-2-77, Case No. 44-SU-77, and Case No. 45-V-n ~n the 22nd of September, 1977, on a request to vacate Isabella Street between t-Yorth-, ~V'est Highway and a point some 792 feet East Thereof with ultimate conveye.nce of i I' I ~he entire right of way to the Mount Prospect Park District; and I, II I ~IHEREAS, a notice of the aforesaid public hearing was made and pu.blished in ~he manner provided by law; and ~'lHEREAS, the Zoning BOA-I'd of Appeals of the Village of Mount Prospect has re-- i~ommended to the President and Board of Trustees of the Village of Mount Prospect hat the petitioner's request und.er said Case No. 43-Z-77} Case No. 44'-SU-77, Hnd , ase No. 45-V-77 be granted; and I I HEREAS, the Building Committee of the Board of Trustees of the Village of Mount rospect has reviewed the matter herein and has unanimously recommended the pproval thereof to the President and Board of Trustees of the Village of Mount rospect; and I HEREAS, the President and Board of Trustees of the Village of Mount Prospect ave determined that the best interests of the Village of Mount Prospect will be .ttained by the adoption of the following Ordinance regarding the subject property; I , OW , THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF fRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLiNOIS: I SECTION ONE: That, pursuant to the authority vested in the President and oard of Trustees of the Village of Mount Prospect under Articlc VII of the 1970 onstitution of the State of Illinois and other authority vested in the President , d Board of Tru.stees of the Village of Mount Prospect under Section 11-91-1 , f the Illinois Municipal Code, the following described public rig'ht of way: sabella Street betvveen Northwest Highway and a point some 792 feet East ~hereof, which vacation is legally described as: Ii All that part of Isabella Street which lies west of a line drawn I' I from the Northeast corner of Lot 38 in II. Roy Berry Company's Northwest Heights, hereinafter described to the southeast corner of Lot 37 an.d which lies east of the west line of Lot 64 extended south to the northeasterly line of Northwest Highw<1Y and which lies northwesterly of the northeasterly line of said Northwest Highway in H. Roy Berry Company's Northvl€st Heights, being a. subdivision of all that land lying north of the Chicago and North- western Railroad, in the Northwest 114 of the Southeast 1/4 of Section 33, Township 42 North, Range 11 East of the Third Prin- cipal Meridian, in Cook County, Illinois. \ ~ , II . ~ " i1 II 11 ,Ii .j"" 'I I, II i~ECTION TWO: That the Village shall retain upon the above described tract Itm easement for public utilities.
