HomeMy WebLinkAboutRes 08-79 03/16/1979 . . , " ltGREEMENT /' , This agreement entered int~ this 21:i;th day of and between the STATE OF ILLINOIS, acting by and through hereinafter called the STATE, the COUNTY OF COOK, of the called the COUNTY, and the VILLAGE OF MOUNT PROSPECT, of Illinois, hereinafter called the VILLAGE. . ,,. -.." p/~i"o, - A'.D., 19~ its D artment of Trans~ortat~: State of Illinois, hereinafte~ Cook County, of the State of by WITNESSETH: WHEREAS,. the STATE, in order to facilitate the free flow of traffic and insure safety to the motoring public, is desirous of improving the intersection of Euclid Avenue {PAU Route 12 and Burning Bush Lane (Lee Street) by installing traffic control signals (to be known as STAT Section 0408TS-78 and as VILLAGE Section 78-00065-00-TL), ;installing "0pticom" Emergency Pre-emption Equipment, and by performing all other work necessary to complete the improvement in accordance with the plans and"specifications; and, WHEREAS, the COUNTY and VILLAGE are desirous of said improvement in that same will be of immediate benefit to the residents of the COUNTY and VILLAGE, and perrnanentin nature, and, WHEREAS, the intersection of Euclid Avenue and Burning Bush Lane lies within the corpora limits of the VILLAGE. t ~OWI, THEREFORE, in consideration of the mutual covenants, contained herein, the parties hereto agree as follows: ! II The STATE agrees to prepare plans and specifications, receive bids, award the contract, I furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans, specifications, and contract. The STATE also agrees to pay i all construction and engineering costs subject to reimbursement by th~ VI~G~ a~ i ,- hereinafter stipulated. and to indemnify the COUNTY from anY,legal act10n or1g1nat1ng ; in the STATE contractor's negligence throughout his contract~ 2~ The COUNTY and VILLAGE agree to approve the plans and specifications by letter or resolut prior to the STATE advertising for the work ~o be performed hereunder. 3~ It is mutually agreed that the proportional participation for the construction costs and engineering costs of th~s.improvement shall be as follows: FEDERAL STATE VILLAGE' COUNT' FUNDS FUNDS FUNDS FUNDS Traffic Signals 85% T~5% 7.5% -0- "Opticom" Equipment -0-' -0- 100% -0- 4. It is mutually agreed that the estimated construction costs and engineering costs of this improv~ment are as follows: FEDERAL STATE VILLAGE FUNDS FUNDS FUNDS TOTAL Traffic Signals $39,100 ~ 3, 450 $3,450 $46,000 .. It is mutually agreed that the VILLAGE will reimburse the STATE in an amount equal to' the , VILLAGE'S share of the actual cost as determined in accordance with Item 3 above. It is mutually agreed that upon award of the contract for this improvement, the VILLAGE will pay to the Department of Transportation of the State of Illinois, in a lump sum from any -..funds allotted to the VILLAGE, under the Motor Fuel Tax Law, an amount equal to 95% of its obligation incurred under this agreement, and will pay to the said Department the remainder of its obligation (including any non-participating costs for FA projects) in a lump sum, upon completion of the project based upon final 'costs. 6. The VILLAGE has passed a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto as ":Exhibit A" and made a part hereof. 7., ~t is mutually a~eed that the financial responsibility for the maintenance of the traffic signals and the energy charges for the operation' of the traffic signals ~hall be divided as follows: INTERSECTION COUNTY'S Share VILLAGE'S Share Euclid Ave. @ Burning Bush Lane 50% 50% 8. Upon the completion of 'this improvement, the COUNTY shall be re~ponsible for the maintenan of the traffic signals and "Opticom" equipment. (\, The VILLA(;E shall be responsible for the maintenance costs of the "0pticom" equipme~t'. 9. It is mutually agreed that the COUNTY will send tq the VILL~GE an itemized invoice every three months covering the VILLAGE'S share (50%) of the actual cost for the maintenance of the traffic signals during the preceding period. Upon receipt of said invoice, the VILLAGE agrees to pay to the COUNTY the amount of the invoice by certified check. 10. The STATE agrees to make arrang~ents with the local power company to furnish electrical energy 'for the operation of the'traffic signals and to bill the COUNTY and the VILLAGE the proportional shares of the ,energy charges as determined in accordance with Item 7 above. II. The COUNTY shall retain ,the righ~ to control the sequence and timing of the traffic signal_ 12. The VILLAGE has adopted and will put into effect, prior to advertising for the work to be performed hereunder, an ordinance requiring that parking be prohibited adjacent to this improvement on the approaches lying within the corporate limits of the VILLAGE, a copy of which is attached hereto as "Exhibit B" and will, in the future, prohibit parking at such , locations on orimrnediately adjacent to this improvement as may be determined to be necessary by the STATE from traffic capacity studies. 13. The VILLAGE agrees to exercise its franchise right to cause private utilities to be relocated at no expense to the STATE. 14. The STATE agrees to comply with all applicable Executive Orders and Federal Highway Acts pursuant to the Equal Employment Opportunity and Nondiscrimination Regulations required by the u.S. Department of Transportation. 15. This agreement and the covenants contained herein shall become null and void in the event the contract covering-the construction work contemplated herein is not awarded by June 30, 1982. -3- , . f. .. ~6. ' EXHIBIT A WHEREAS, the Village of Mount Prospect has entered into an Agreement with the State of Illinois for the installation of traffic control signals and "Opticom" equipment at the intersection of Euclid Avenue at Burning Bush Lane (Lee Street), known as STATE Section 0408TS-78 and as VILLAGE Section 78-00065-00-TL; 'and, WHEREAS, in compliance with the aforementioned Agreement, it is necessary for the VILLAGE to appropriate sufficient Motor Fuel Tax Funds to pay its share of the cost of said traffic signal improvement. SECTION 18.1316. Sunday Park~. Except in compliance with the dir- ection of a police officer or traffic signal. it shall be unlawful to permit any vehicle to stand, stop. or park in any of the places designated by the Vil- lage Manager and signposted and includeo on Schedule VII of the Appendix to this Chapter. SECTION 18.1317'. Weekday Parking. The parking of any vehicle is pro- hibited on illl weekdays, excluding Saturdays. Sundays and legal holidays between those hours and on those streets designated by the Village l\!anager and signposted and included on Schedule VIII of the Appendix to this Chap- ter. SECTION 18,1318. Parking During School Hours, The parking of any vehicle is prohibited on school days between the hours of 8: 00 o'clock a.m. and 4: 00 0' clock p. m. on such streets designated by the Village III anager and signpostcd and included 011 Schedule IX of the Appendix to this Chap- ter. SECTION 18.1319. All Night Parking'. A. No person shall park any vehicle on any street within the Vil1ag'e be- tween the hours of 2: 00 o'clock a.m. and 6: 00 o'clock a.m. on any day, except physicians on emergency calls. \ B. The parking of any vehicle is prohibited between the hours of 6: 00 o'clock p.m. and 6: 00 o'clock a.m. on such streets designated by the Village Manager and signposted and included on Schedule X of the Appendix to this Chapter. SECTION 18,1320. Time Limits. It shall be unlawful to park any vehicle for a longer period than the time desig'nated in any area set aside by the Village lVIanager, signposted and included on the Schedules listed below: A. Two Hour PI!rking. Parking of automobiles and other vehicles is limited to two (2) hours on any day except Sundays and legal holi- days between the hours of 7:00 o'clock a.m, and 6: 00 o'clock p.m. on the streets or portions thereof included on Schedule XI of the Appendix to this Chapter. B. Thirty Minute Parking.
