I AN ORDINANCE ESTABLISHING THE OFFICE OF COMMUNITY DEVELOPMENT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Article III of Chapter 4 of the Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the same is hereby further amended in its entirety by deleting the Department of Building and Zoning therefrom and substituting therefor the Department of Community Development; so that hereafter the said Article III shall be and read as follows: " ARTICLE III. DEPARTMENT OF COMMUNITY DEVELOPMENT Section 4.301. Creation of Department. . Ii I A. There is hereby established a Department of Community Develop- ment, which shall be under the jurisdiction and control of the Village Manager. 1. The head of the Department of Community Development shall be known as the Director of Community Development and shall be an official of the Village of Mount Prospect. 2. The Director of Community Development shall be appointed by the Village Manager for an indefinite period of time. . B. The Department of Community Development shall be composed of such other officials, assistants, and employees, including inspectors, clerks, and other employees, as may be necessary to carry out tbe functions of the Department and as may be financed by the President and Board of Trustees in the annual budget of the Village of Mount Prospect. Section 4.302. Purpose. The Director of Community Development is hereby authorized to administer and enforce the provisions and' . regulations of this Municipal Code with respect to zoning, planning, and engineering, including the use of buildings and premises located within the corporate limits of the Village of Mount Prospect. He must have a knowledge of all three of the aforesaid disciplines as well as budgeting, forecasting BUD, EDA, HEW and DOT programs and pro- cedures, and other aspects of code development. A. The Department of Community Development shall include the office of zoning administrator. 1. The Zoning Administrator and/or his duly appointed and/or authorized representatives shall have the responsibilities of administering and enforcing the Zoning Ordinance of the Village of Mount Prospect, along with the following specific duties: a. To receive and process applications for zoning certificates for structures or additions thereto for which building permits are required; b . To receive and process applications for zoning certificates not accompanied by an application for a building permit; n c. To receive and process applications for an occupancy certificate upon the completion of a structure or when there is a change of use as herein provided; d. To conduct inspections of structures or the use of land to determine whether there is compliance with the Zoning Ordinance, and, in the case of any violation, to notify in writing the person or persons responsible, specifying the nature of the violation and order a corrective action; e. To maintain in current status the official zoning map; f. To maintain permanent and current records required by the Zoning Ordinance, including but not limited to zoning certificates, occupancy certificates, inspections, and all official action on appeals, variations, and amendments; g. To prepare and have available in book, pamphlet, or map form, on or before March 31, of each year: (1) The compiled text of the Zoning Ordinance, including all amendments thereto through the preceding December 31; and (2) A zoning map or maps, showing the zoning districts, divisions, and classifications in effect on the preceding December 31. h. To notify other administrative officials within other depart- ments of the Village of Mount Prospect as to pending matters and from time to time coordinate and arrange, under the auspices of the Village Manager, meetings between de- velopers, builders, etc., and administrative officials of the Village of Mount Prospect to facilitate the solving of engineer- ing, layout, and design problems prior to meetings with and/ or hearings before the Zoning Board of Appeals and/or Plan Commission, as the case may be . i. To maintain for distribution to the public a supply of the rules and by-laws of the Zoning Board of Appeals; and j. To accept applications for public hearings before the Zoning Board of Appeals and to forward same to the Office of the Village Clerk, for processing and publication of proper legal notice. . B. The Department of Community Development may include the office of Village Planner. 1. The Director of Commu'nity Development shall serve ex-officio as the Village Planner until such time as an Assistant Director of Community Development is named to serve in such capacity. 2. The Village Planner shall be chosen on the basis of his pro- -2- I I I ' II ! fessional, educational, and administrative competence in the area of local government operation with respect to land use and resultant service loads, data collection and analysis I procedures, and poÎicy formulation and implementation methods, I C . The Department of Community Development shall include the office of Village Engineer. 1. The Village Engineer shall have a degree in civil eingineering from an accredited college or university, have practical experience in engineering, and shall be licensed as a pro- fessional engineer pursuant to the applicable statutes of the State of Illinois. 2. The Village Engineer will give technical advice and furnish professional engineering services to the Village of Mount Prospect in connection with planning, zoning, and the execu- tion and construction of public works and improvements. a. The work of the Village Engineer shall be performed under the direction of the Director of Community Development.. I I 'I SECTION THnEE: That S.ction 4.102 of the Municipal Cod. of tho Villag. of I Mount Prospect of 1957, as amended, be and the same is hereby further amended I by expanding upon the powers of the office of Fire Chief; so that hereafter the said Section 4. 102 shall be and read as follows: b. The Village Engineer shall also perform such other duties as may be required of him from time to time by the Director of Community Development. 11 SECTION TWO: That Article VI of Chapter 4 of the Municipal Code of the Village ," ~~ ~;~Uer;:t:Je;p~;t d ~l:t;~~' t~: :~:¡~~ et~~tb:h::;'~ha: ~a::~::v~;e~~~~~~¡~:m end. for future use; so that hereafter Article VI shall be and read as follows: " ARTICLE VI. RESERVED." I I " Section 4.102. Office of Fire Chief. A. The Director of the Fire Department, hereinafter referred to as the "Fire Chief!!, shall be appointed by the Village Manager. Should the appointment to the position of Fire Chief be given to a member of the Mount Prospect Fire Department, said appointee shall not lose his then existing rank as established by the Fire and Police Commission of the Village of Mount Prospect during his tenure as Fire Chief. B. In addition to directing the regular and volunteer fire department of the Village of Mount Prospect, the Fire Chief shall serve ex-officio I as the Chief of the Bureau of Fire Prevention of the Fire Department. 1. The Bureau of Fire Prevention shall consist of a Superintendent of Building and other civilian members, as well as such sworn Fire Department personnel as may be appointed by the Chief for the purpose of administering and enforcing the regulations of the MUl1icipal Code of the Village of Mount Prospect relating to Building, fire prevention, and safety. . The Chief of the Bureau of Fire Prevention, the Building Superinendent, or their authorized agents and representativ s shall have the power to order all work stopped on constructi or alterations and/or repairs to buildings within the corporat limits of the Village of l\.1ount Prospect whenever such work is being done in violation of any of the provisions of any ordinance relating thereto including the Building and Zoning Codes of the Village of Mount Prospect. b. The Chief of the Bureau and/or the Superintendent of Building, or their authorized agents and representatives, shall have the power, for the purposes of making inspections at any reasonable time, to make or cause to be made entry into any building or premises where work of altering, repairing. and / or constructing any building or structure is commenced. The Superintendent of Building shall serve ex-officio as Chief Electrical Inspector and, as such, shall also serve as Chairman of th~ Electrical Commission of the Village of Mount Prospect. :l. The Chief Electrical Inspector or his authorized agent or representative shall enforce all of the ordinances of the Vil- lage of Mount Prospect relating to electricity, and shall super vise, inspect, and approve the installation of all electrical wires and apparatus. b. Should any such electrical wires or apparatus be found unsaf to life and property, the Chief Electrical Inspector or his authorized agent or representative shall notify the person, firm, or corporation owning. using, installing. or building such electrical device and inform such person, firm, or corpo a tion to place such wires and/or apparatus in safe condition within a reason3ble time, not to exceed five days after receipt of such notice. II SECTION PO; rR: That Subsection A of Section 14.202 of Chapter 14 (the Zoning I Ordinq.nce) of the Municipal Code of the Village of Mount Prospect of 1957, as I amended, be and the same is hereby further amended by deleting the words "Building and Zoning" and substituting therefor the words "Community Develop- ment; so that hereafter the said Subsection A shall be and read as follows: The Director of Community Development of the Village of Mount Prospect shall. serve ex-officio as the head of the Office of the Zoning Administrator and shall from time to time here- under be referred to as t1theZoriing Administrator" . I SECTION FIVE: That Subsection A of Section 14.301 of Chapter 14 (the Zoning Ordinance) of the Municipal Code of the Village of l\-Iount Prospect of 1957, as amended', be and the same is hereby further amended by deleting therefrom f¿ference to the issuance of building permits by the Zoning Administrator; so that hereafter the said Subsection A shall be and read as follows: " A. A. No building permit pertaining to the construction, moving, re- modeling. or reconstruction of any structure shall be issued by the Superintendent of Building of the Village of Mount Prospect unless an application for a Zoning Certificate shall first have been made to and obtained from the Zoning Administrator. Unless a Zoning Certificate shall first have been obtained from the office " -4- I I ! I of the Zoning Administrator: 1. The construction, moving, remodeling, or reconstruction of any structure shall not be commenced; 2. The improvement of land preliminary to any use of such land shall not be commenced; and 3. Permits pertaining to the use of land or structures shall not be issued by any official, officer, employee, department, board, or commission of the Village of Mount Prospect-.
