HomeMy WebLinkAboutOrd 2909 05/15/1979 ORDINANCE NO ~2909 AN ORDINANCE gRANTING SPJ?Ç.IF'IE)) V j\RiA TIONS,FOR PROPERTY --- - - -'~---"'" "' ,--" '^-""4~'""--='"""".",-"",-",-"-,,,,,"-<,,*",->c---- ,,-^,,-,,-,,-,,---,t-,,~-"'-, ,,/~,>,,"-",>-->,,",-,,-- '>" ,,-,"- COMMONLY KNOWN AS THE "NI-GASJ?ROPE!ìTY" -" WHEREAS, Northern Illinois Gas Company is the Owner and Rauenhorst Corportation is the developer (hereinafter Northern Illinois Gas Company and Rauenhorst Corporation shall be referred to collectively as "Petitioners") of a parcel of property located on the south side of Kensington Road and west of Wolf Road which is commonly known as the "Ni-Gas Property" in the Village of Mount Prospect, Cook County, State of Illinois (hereinafter referred to as the "Subject Property"); and I WHEREAS, the Subejct Property is legally described as follows: The West Half of the West Half, except the North 644 feet of I the West 450 feet thereof, of the Northwest Quarter of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian also The East 75 feet of the South 110 feet of the Southeast Quarter of the Northeast Quarter of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian also The North 100 feet of that part of the Northeast Quarter of the Southeast Quarter of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, lying Easterly of the center line of Rand Road, all in Cook County, Illinois; II and WHEREAS, the Subject Property is located in the 1-1 Light Industrial District under the provisions of the Zoning Ordinance of the Village of Mount Prospect II (hereinafter referred to as the "Zoning Ordinance"); and WHEREAS, Petitioners have heretofore filed an application seeking the following _variations from the provisions of the Zoning Ordinance: 1. A variation from Section 14.2203A of Article XXII of the Zoning Ordinance which requires aminimumlot size of four acres to permit the developmenfof the SúbjeCtPrOper!y with two lots of one and one-half acres each and eight lots of not less than two acres; 2. A variation from Section 14.2205 A of Article XXII of the Zoning I Ordinance which requires one off-street parking space for each two hundred feet , of gross floor area to permit one off-street parking space for each three hundred feet of gross floor area utilized for office purposes and one off-street parking space I I for 7h :W~~:~:;¿i;~i::t 1:~ ::: :ro:a devoted to :~:::::::rposes; I' Ordinance which specifies the number of required off-street truck parking and I II loading spaces to reduce the number of such off-street truck parking and loading I spaces for office spaces to permit the development of the Subject Property with one I off-street truck parking and loading space for each 100,000 square feet or fraction thereof of square feet utilized for office purposes in each building to be constructed on the Subject Property; and WHEREAS, a public hearing was held on the Petitioners' request for the aforesaid variations, which request is known as ZBA 11-V-79, before the Zoning Board of Appeals of the Village of Mount Prospect on March 21, 1979, pursuant to proper notice published in the Mount Prospect Herald on March 5, 1979; and WHEREAS, the Zoning Board of Appeals has recommended to the Building Committee of the Board of Trustees of the Village of Mount Prospect that Peti tioners' request for the aforesaid variations, ZBA 11- V - 79, be granted; and I WHEREAS, the President and Board of Trustees have considered the Petitioners' I, I request and reviewed the recommendations of the Village of Mount Prospect Zoning I Board of Appeals in ZBA 11-V-79; and I I WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that with respect to the Petitioners' request for variations from the lot size requirements, off-street parking requirements and off-street truck I parking and loading requirements, that Petitioners have satisfied the standards for the grant of a variation set forth in Section 14.605 of Article VI of the Zoning I Ordinance and find that it would be in the best interest of the Village of Mount Prospect to grant Petitioners the following variations: I 1. A variation from the minimum lot size set forth in Article XXII, Section 14.2203 A of the Zoning Ordinance to permit two lots of I! (one and one-half) acres each and eight lots of not less than two acres on the Subject 1 Property; I 2. A variation from the parking requirements of Article XXII, Section 14.2205 A of the Zoning Ordinance to permit one off-street parking space for each two thousand square feet or fraction thereof of floor area devoted to warehouse use and" one off-street parking space for each 250 square feet or fraction thereof of floor area devoted to office space; I 3. A variation from the off-street truck parking and loádlngre'q[ûirements I for office use to permit one off-street truck parkihg andÎos:ding spâéefor' , ::: ::~::::::~r:;e:; :R::::: :;r;:E O:::::ú;;; :t::::::e ;::~ TEES I I OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS as follows: I r I SECTION ONE: The recitals set forth hereinabove are incorporated herein as though fully set forth. - SECTION TWO: Subject to the conditions hereinafter set forth in SECTION THREE of this Ordinance No. 2909, the President and Board of Trustees of the Village of Mount Prospect hereby grants the following variations for the Subject Property: a. A variation from the provisions of Article XXII of the Zoning Ordinance requiring minimum lot sizes offour acres in the 1-1 Light Industrial I' District be, and the same is hereby granted to permit the development of the Subj ect Property with two one and one-half acre lots shown as Lots 4 and 5 on ¡ , -2- the preliminary site plan for the Subject Property which is attached hereto as I Exhibit A and incorporated herein by this reference and with eight additional lots of not less than two acres apiece as are shown on Exhibit A hereto. I ¡ I I I I c. A variation from the provisions of Article XXII, Section 14.2205 B, i to reduce the required number of off-street truck parking and loading spaces for I office use to permit the development of the Subject Property with one off-street ¡ truck parking and loading space for each 100,000 square feet or fraction thereof I utilized for office space in each building to be constructed on the Subject ! Property; provided however, that the requirements of Article XXII, I Section 14. 2205B, shall remain in full force andef'fectfor any portion of any ! building to be constructed on the 'Subject Property which is used for I warehouse purposes. . . . .." ". ... " ¡ SECTION THREE: That variations granted hereinabove in SECTION TWO I of this Ordinance No. 2909, are granted subject to the following conditions: II 'I a. No off-site parking for any lot into whichthe Subject Property is divided as shown on the Subdivision Plat, Exhibit B hereto, shall be permitted. lb. "No parking shall be permitted on any street shown on the Subdivision Plat for the Subject Property, Exhbit B hereto. II c. Any streets shown on the Subdivision Plat for the Subject Property, Exhibit B hereto, shall be installed and constructed in such a I manner and of such materials to withstand the type, weight and extent of ! vehicular traffic which shall travel such streets. Plans and specifications for such streets shall be submitted to the Village Engineer for review and approval. b. A variation from the provisions of Article XXII, Section 14.2205 A.l which requires one off-street parking space for each two hundred feet of gross . I floor area in a building to permit one off-street parking space for each two thousand I square feet or fractionthereof of any portion of any building to be constructed on : the Subject Property which is used for warehouse purposes and one off-street parking space for each two hundred and fifty square feet or fraction thereof of any portion of any building to be constructed on the Subject Property which is used for office purposes. I d. Screening, consisting of a berm planted with grass or other I suitable ground cover or densely planted trees, shrubs, bushes or other II suitable plantings, shall be provided in and along the lot line of any lot into I which the Subject Property is divided as shown on the Subdivision Plat, Exhibt B ¡hereto, if such lot line abuts, adjoins, is adjacent to or is across the street from any real estate zoned or used for residental purposes. Landscaping consisting of I trees, shrubs, bushes, or other plåntings shall be provided at appropriate locations on each lot into which the Subject Property is divided as shown on the Subdivision Plat, Exhibit B hereto. Any portion of each lot into which the Subject I Property is divided which is not used for buildings, sidewalks, accessway, I driveways, parking purposes, or lakes and ponds, and is not otherwise landscaped as provided for herein, shall be landscaped with grass, other suitable ground , cover or other suitable landscaping materials. ! A landscaping plan, including screening, if required, shall ! be submitted to the Director of Community Development for review and approval. ¡ Such landscaping plan or screening plan" shall be submitted and approved prior , to the issuance of any occupancy certificate for any building constructed on the site. The landscaping and screening provided for herein and i which is approved by the Director of Community Development shall be properly 1 -3- maintained at all times. e. No building permit for any building to be constructed on the Subject Property shall be issued unless and until a site plan therefor has been submitted to and approved by the Director of Community Development. Such site plan shall be drawn to scale and shall show the location, height, and dimensions of buildings, the location of off-street parking spaces with each individual parking space indicated, the number of square feet of each such building devoted to office, warehouse, or other industrial use, and access to and egress from the site. SECTION FIVE: If any of the conditions in SECTION THREE of this Ordinance No. 2909 are not met, satisfied, or are violated on any lot into which the Subject Property is divided as shown on the Subdivision Plat, Exhibit B hereto, the variations granted herein for said lot shall be null and void and the then applicable provisions of the Village of Mount Prospect Zoning Ordinance shall be deemed to be in full force and effect as to that lot of the Subject Property. SECTION FOUR: This Ordinance shall be recorded with the Cook County Recorded of Deeds or Registrar of Titles, whichever is applicable, and the variations granted herein and the conditions on their grant shall be deemed to run I with the Subject Property and be binding upon any and all heirs, successors, I assigns of the owner, successor owners of the Subject Property and developers and lessees of the Subj ect Property. I ! [ SECTION SIX: Except for the variations granted herein, all other applicable Village of Mount Prospect ordinances shall remain in full force and effect as to the Subject Property. SECTION SEVEN: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
