AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY LOCATED AT 2024 WINTERG~EEN WHEREAS, Harmon and Dolores Loeb (who shall be to collectively as "Petitioners") are the owners of a arcel of property located at 2024 Wintergreen Avenue in the ill age of Mt. Prospect, County of Cook, State of Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is legally described as follows: Lot 495 in Woodview Manor, Unit No.4, being a subdivision of part of the Southeast 1/4 of Section 24," Township 42 North, Range ,11 East of the 3rd Principal Meridian, in Cook County, Illinois. and WHEREAS, the Subject Property is located in the R-l Single Family Residence District under the provisions of the Zoning Ordinance of the Village of Mt. Prospect (hereinafter referred to as the "Zorling Ordinance"); and WHEREAS, Petitioners have heretofore filed an applica tion' seeking the following variations from the provisions of the Zoning Ordinance: 1. A two (2) foot ten (10) inch variation from Section 14.1102 paragraph A of Article XI of the Zoning Ordinance which requires any building or structure to be set back from the front lot line at least thirty (30) feet, to permi a front yard of twenty-seven (27) feet two (2) inches; 2. A three (3) foot three (3) inch variation from Section 14.1102 paragraph B of Article XI of the Zoning Ordinanc which requires a minimum side yard along each side of any lot to have a width of not less than ten percent (10%) of the lot or ten (10) feet, whichever is the lesser, to permit a side yard of six (6) feet on the east side of the Subject Property; 3. A fourteen (14) foot variation from Section 14.11 2 paragraph C of Article XI of the Zoning Ordinance which requires any building or structure to be set back from the rear lot line at least twenty-five (25) feet, to permit a rear yard of eleven . . . . ," " . . . A variation from Section 14.1105 paragraph B of ticle XI of the Zoning Ordinance which permits a maximum of e two-car garage per each detached dwelling, to permit the nstruction of a second two-car garage on the Subject Property; 5. A twenty-five (25) foot variation from Article 210.2 Section bel) of the Village of Mount Prospect Building C de which requires a minimum set back of seventy-five (75) feet f om the front lot line for a detached garage on an interior lot, t permit the construction of a detached garage fifty (50) feet f om the front lot line of the Subject Property; WHEREAS, a public hearing was held on the Petitioners' r quest for the aforesaid variations, which request is known as Z A-66-V-78, before the Zoning Board of Appeals of the Village 0 Mount Prospect on May 3, 1979, pursuant to proper public n ice ~published in the Mount Prospect Herald on April 16,1979; an 0 WHEREAS, the President and Board of Trustees have WHEREAS, the Zoning Board of Appeals has recOmmended t the Building Committee of the Board of Trustees of the Village Mount Prospect that Petiti~ners's request for the aforesaid v iation, ZBA-66-V-78, be granted; and co sidered the Petitioners' request and reviewed the recommenda- ti n of the Village of Mount Prospect Zoning Board of Appeals in ZBA-66-V-78; and WHEREAS, the President and Board of Trustees of the Vi lage of Mount Prospect have determined that with respect to th Petitioners' request for variations from the front yard set ba k requirements, the side yard width requirements, the rear ya d set back requirements, the limit of one two-car garage per de ached dwelling, and the minimum Set back requirement for a de ached garage on an interior lot, that Petitioners have satisfied th standards for the grant of a variation set forth in Section 14.0 - ~.' - '.l. :. . . . - , . '. . , . " , . "3- of Article VI of the Zoning Ordinance and find that it would be in the best interest of the Village of Mount Prospect to grant Petitioners the following variations: 1. A two (2) foot ten (10) inch variation from Section 14.1102 paragraph A of Artixle XI of the Zoning Ordinanc to permit a front yard of twenty-seven (27) feet two (2) inches; 2. A three (3) foot three (3) inch variation from Section 14.1102 paragraph B of Article XI of the Zoning Ordinanc to permit a side yard of si~ (6) feet on the east side of the Subject Property; 3. A fourteen paragraph C of Article XI yard of eleven (11) feet; (14) foot variation from Section 14.11 2 of the Zoning Ordinance to permit a re r 4. A variation from Section 14.1105 paragraph B of Article XI of the Zoning Ordinance which permits a maximum f one two-car garage per each detached dwelling, to permit of a second two-car garage on the Subject roperty; 5. A twenty-five (25) foot variation from Article -210.2 Section bel) of the Village of Mount Prospect Building ode which requires a minimum set back of seventy-five (75) feet rom the front lot line for a detached garage on an interior lot, 0 permit the construction of a detached garage fifty (50) feet rom the front lot line of the Subject Property. NOW, THEREFORE, BE IT ORDAINED BY THE - PRES;rDENT AND OARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, Cook County, llinois as follows: SECTION ONE: The recitals set forth hereinabove are ncorporated herein as though fully set forth. SECTION TWO: The President and Board of Trustees of he Village of Mount Prospect hereby grants the following varia- ions for the Subject Property: , .' - ' c 1 ' . . , . ", ", ;4- . ~ i.' , c- 1.
