HomeMy WebLinkAboutOrd 2912 06/05/1979 . c , ORDINANCE NO. 2912 AN ORDINANCE ESTABLISHING VILLAGE OF MOUNT PROSPECT SPECIAL SERVICE AREA NUMBER 1 BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois, as follows: SECTION ONE: Authority. The Village of Mount Prospect Special Service Area Number 1 is established pursuant to the provisions of Ill. Rev. Stat., 1977, Ch. 120 §130l et seq., an "Act To Provide The Manner of Levying Or Imposing Taxes For The Provision Of Special Services To Areas Within The Boundaries Of Home Rule Units And Non-Home Rule Municipalities And Counties". SECTION TWO: Findings. A. The question of the establishment cof the area hereinafter described as a special service area was con- sidered by the President and Board of Trustees pursuant to "An Ordinance Proposing Establishment Of A Special Service Area In The Village Of Mount Prospect And Providing For A Public Hearing And Other Procedures In Connection Therewith", being Ordinance 2876 and was considered at a public hearing held on March 20,1979, by the Village Board pursuant to notice duly published in The Mount Prospect Herald on March 5,1979, a newspaper of general circulation within the Village of Mount Prospect, at least fifteen (15) days prior to the hearing and pursuant to notice by mail addressed to the person or persons in whose name the general taxes for the last preceding year were paid on each lot, block, tract or parcel of land lying within the special service area. . 6 , c II -j "","""",," . < , ~ - 2 - Said notice was given by depositing said notice in the United States mail not less than ten (10) days prior to the date set for the public hearing. In the event taxes for the last preceding year were not paid, said notice was sent to the person last listed on the tax rolls prior to that year as the owner of said property. A Certificate of Publication of notice and an Affidavit of Mailing of notice are attached to this Ordinance as Exhibits A and B. Said notices conformed in all respects to the requirements of Ill. Rev. Stat., 1977, Ch. 120 §1305, aforesaid. B. A public hearing on the question set forth in said notices was held on March 20,1979. All interested per- sons were given an opportunity to be heard on the question of the creation of the special service area and the acquisi- tion of the existing Prospect Meadows Water Company and the construction of substantial additions to that system to serve said special service area. C. That after considering the data, questions and objections, as presented at the public hearing, the President and Board of Trustees finds that it is in the best interest of the Village of Mount Prospect and of the residents and owners of property located within Special Service Area Number 1 of the Village of Mount Prospec~, that said special service area, as hereinafter described, be established. D. Said area is contiguous as required by Ill. Rev. Stat., 1977, Ch. 120 §1301 et seq. E. It is in the best interests of the Village of Mount Prospect that said special service area be created for the acquisition of the existing Prospect Meadows Water Company and the construction of substantial additions to that system to serve said special service area. .. Village of Mount Prospect Special Service Area Number 1 Established. SECTION THREE: A Special Service Area to be known and designated as IIVillage of Mount Prospect Special Service Area Number 1," is hereby established and shall consist of the contiguous territory legally described in Exhibit C hereto, which descrip- tion is by this reference incorporated herein. SECTION FOUR: Purpose of Area. Village of Mount Prospect Special Service Area Number 1 is established to provide services to said area through the acquisition of and the construction of substantial additions to and improvements of existing facilities of the Prospect Meadows Water Company. No Objections to Establishment. SECTION FIVE: No petition objecting to the creation of Village of Mount Prospect Special Service Area Number 1 was filed with the Village within 60 days. following March 20,1979, the datè of the adjournment of the public hearing held to consider the creation of Village of Mount Prospect Special Service Area Number 1. SECTION SIX: Effective Date. This Ordinance shall be in full force and effect ten (10) days after its passage, approval and publication in the manner provided by law.
