HomeMy WebLinkAboutOrd 2915 06/19/1979 ~ ,. . " ".. ,. . ORDINANCE NO. 2915 AN ORDINANCE GRANTING A VARIATION FOR 709 CHRIS LANE WHEREAS, JOSEPH J. RUNTZ and LESLIE TEKLICS (who shall be referred to collectively as "Petitioners") are the owners of a parcel of property located at 709 Chris Lane in the Village of Mount Prospect, County of Cook, State of Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is legally described as follows: Lot 8 in Semar's Resubdivision in Mou~t Prospect, being a Resubdivision of part of the Southeast Quarter of Section 10, Township 41 North, Range 11 East of the Third Principal Meridian, in the Village of Mount Prospect, Cook County, Illinois. WHEREAS, the Subject Property is located in the R-1 Singl Family Residence District under the provisions of the Zoning Ordinance of the Village of Mount Prospect (hereinafter referred to as the "Zoning Ordinance"); and WHEREAS, Petitioners have heretofore filed an application seeking a variation from the provisions of Section 14.1101 B 4 Zoning Ordinance of the Village of Mount Prospect to permit the construction of a three car garage on the Subject Property; and WHEREAS, a public hearing was held on the Petitioners' request for the aforesaid variation" which request is known as ZBA-19-V-79, before the Zoning Board of Appeals of the Village 0 ount Prospect on May 3,1979, pursuant to proper public notice ub1ished in the Mount Prospect Herald on April 16, 1979; and WHEREAS, the Zoning Board of Appeals has recommended to e Building Committee of the Board of Trustees of the Village of ount Prospect that Petitioners' request for the aforesaid rriatiOn, ZBA-19-V-79 , be granted; and /' .~ " -.-/ ,. . WHEREAS, the President and Board of Trustees have considered the petitioners' request and reviewed the recommenda- tion of the Village of Mount Prospect Zoning Board of Appeals in ZBA-19-V-79; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that with respect to the Petitioners' request for a variation to permit the construc- tion of a three-car garage on the Suþject Property, that Petitioners have satisfied the standards for the grant of a variation set forth in Section 14.605 of Article VI of the Zonin Ordinance and find that it would be in the best interest of the Village of Mount Prospect to grant petitioners the requested variation. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois, as follows: Section One: The recitals set forth hereinabove are incorporated herein as though fully set forth. Section Two: The President and Board of Trustees of the Village of Mount Prospect hereby grant Petitioners a variation from the provisions of Section 14.1101 B4 of the Zoning Ordinanc of the Village of Mount Prospect to permit the construction of a three-car garage on the Subject Property in accordance with the plans therefor which are attached hereto as Exhibit A and incor- porated herein by this reference. Section Three: This Ordinance shall be recorded with . . - ,the Cook County Recorder of Deeds or Registrar of Titles, which- 1. ever is applicable, and the variation granted herein shall be deemed to run with the Subject Property. ,i ; . Section Four: Except for the variation granted herein, all other applicable Village of Mount Prospect ordinances shall -2- ~~.~,~,~ . . ... .. .. remain in full force and effect as to the Subject Property. Section Five: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
