ORDINANCE NO. 2916
AN ORDINANCE AUTHORIZING
A SPECIAL'PERMIT FOR'A DAY CARE HOME
WHEREAS, RICHARD F. and MARGARET M. BOSOLD (hereinafter
referred to as "Petitioners") have requested a special use
permit to operate a day care home at a single family dwelling
at 205 S. Louis Street in the Village of Mount Prospect,
County of Cook, State of Illinois (hereinafter referred to as
the "Subject Property"); and
WHEREAS, the Subject Property is located in the R-1
Singl~ Family Residence District and is legally described as
follows:

Lot.. 22 in Block 18 in Busse's Eastern
Addition to Mount Prospect in the East
1/2 of Section 12, Township 41 North,
Range 11 East of the Third Principal
Meridian, in Cook County, IllinoisA
WHEREAS, Section 14.1101 C of the Zoning Ordinance of
the Village of Mount Prospect provides that a day care home is
a special use in the R-l Single Family Residence District; and
WHEREAS, a public hearing was held on Petitioners'
request for a special use permit to operate a day care home on
the Subject Property, which request is known as ZBA-20-SU-79,
before the Zoning Board of Appeals of the Village of Mount
Prospect on May 3, 1.979, pursuant to proper public notice
published in the Mount Prospect Herald on April 16, 1979; and
WHEREAS, the Zoning Board of Appeals has recommended to
the Building Committee of the Board of Trustees of the Vil1~ge
of Mount Prospect that Petitioners' request for the aforesaid
special use permit, ZBA-20-SU-79, be granted; and
WHEREAS, the President and Board of Trustees of the
Village of Mount Prospect have determined that with respect to

the Petitioners' request for a special use permit to operate a
day care home on the Subject Property, that Petitioners have
satisfied the standards for the grant of a special use permit
set forth in Section 14.704 of Article VII of the Zoning
Ordinance of the Village of Mount Prospect and find that it
would be in the best interest of the Village of Mount Prospect
to grant Petitioners said special use permit provided Petitioner
operate such day care home in accordance with any requirements
of the State of Illinois for such day care homes and further
provided that Petitioners are licensed to operate such day care
home by the State of Illinois.
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Mount Prospect, Cook County,
Illinois as follows:
Section One:
The recitals set forth hereinabove are
incorporated herein as though fully set forth.
Section Two:
The President and Board of Trustees of the
Village of Mount Prospect hereby authorize the issuance of a
special use permit to Petitioners to operate a day care home on
the Subject Property subject to Petitioners' compliance with the
following conditions:
1.
Petitioners must be licensed by the
State of Illinois to operate a day care home on the Subject
Proper ty .
2.
Petitioners shall operate such day care
home in accordance with any requirements imposed by the State
of Illinois for such day care homes.
3.
Petitioners shall operate such day
care home in accordance with all applicable Village of Mount
Prospect ordinances.
Section Three:
The special use permit authorized herein
shall be automatically revoked if Petitioners cease to occupy

the premises of the $uþject Prop~rty.
Section Four:
The special permit authorized herein shall
be subject to revocation if Petitioners fail to operate the
aforesaid day care home in accordance with the conditions herein-
above set forth..in Section Two of this Ordinance No.
2916
Section Five;
The special use permit authorized herein
shall not be deemed to run with the land and shall be issued to
Petitioners only for as long as Petitioners occupy the premises
of the Subject Property and operate a day care home thereon in
accordance with the provisions of this Ordinance No. 2916
Section Six:
This Ordinance shall be ~n full force and
effect from and after its passage, approval, and publication in
