WHEREAS, the Village of Mount Prospect does cooperate with Save-A-Pet, Inc~ in an effort to find homes for cats and dogs that are homeless, lost and/or abandoned; and WHEREAS, the Village of Mount Prospect has agreed to support this program fiancially. NOW, THEREFORE, ! TRUSTEES OF THE I ILLINOIS: I I I I I FE IT RESOLVED BY THE MAYOR AND BOARD OF VILLAGE OF MOUNT PROSPECT, COOK COUNTY, SECTION ONE: That the Mayor is hereby authorized to sign the Purchase of Services Agreement between the Village of Mount Prospect and Save-A-Pet, Inc. and the Clerk authorized to attest her signature of the subject Agreement. SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. AYES: I NAYS: FARLEY, FLOROS, VAN. ATTEST: ¿~rY i1;~ Village Clerk "3 "-8 ~ PURCHASE OF SERVICES AGREEMENT This agreement between Save-A-Pet, Inc., an Illinois not-for- profit corporation and the Village of Mount Prospect, hereinafter referred to as "City,"; WITNESSETH: The parties hereto, upon the terms and conditions hereinafter set forth, mutually agree as follows; 1. Subject to the conditions hereinafter stated, Save-A-Pet, Inc. agrees to accept all animals from the Animal Warden of the City which are considered lost, stray, or otherwise abandoned according to City ordinances in effect on the date of capture. 2. To the extent the City can give good title, all animals accepted from the City by Save-A-Pet, Inc. become the property of Save-A-Pet, Inc., subject to the various internal operating procedures of said organization and all claims on such animals, after acceptance by Save-A-Pet, Inc. become null and void. 3. Save-t-Pet, Inc. shall undertake during the term hereof to provide the following services: A. Accepting, caring for, and finding new homes for the City's stray, homeless, unwanted, and injured dogs and cats which are delivered to it by the City's Animal Warden or their designate. In accordance with the Illinois Animal Control Act #83-740, Save-A-Pet, Inc. will not release any dog or cat unless the animal has been surgically rendered incapable of reproduction by spaying or neutering, or the person wishing to adopt an animal prior to the surgical procedures having been performed shall have executed a written agreement promising to have such service performed within a specified period of time. B. Save-A-Pet, Inc. will provide the necessary distemper and parvo inoculations, and feline leukemia tests, as well as any other medical treatment necessary for such animals in its custody. 4. Save-A-Pet, Inc. shall provide the equipment and labor necessary for the activities herein to be performed by it. C. 5. Save-A-Pet, Inc. shall be solely and absolutely liable and responsible for all the regulation and administration of the animals in its custody including, but not limited to all costs arising from administration, maintenance, and operation. 6. The City shall pay Save-A-Pet, Inc. the sum of $35.00 per animal for the services herein to be provided by said Save-A-Pet, Inc., which amounts shall be payable monthly upon receipt of an invoice from Save-A-Pet, Inc. 7. This agreement shall be in effect for a period of two (2) years from and after September 30, 1984, but may be cancelled at any time prior thereto by either party by giving 60 days prior written notice. The depositing of a notice in the U.S. mail addressed as follows shall constitute sufficient notice hereunder: Save-A-Pet, Inc. P.O.
