VWU 11/10/98 11/20/98 ORDINANCE NO. 4974 AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY COMMONLY KNOWN AS 2200 SOUTH ELMHURST ROAD WHEREAS, Moti Agarwal/Avani Hospitality (hereinafter referred to as Petitioner) has filed a petition for a Conditional Use with respect to property located at 2200 South Elmhurst Road, (hereinafter referred to as the Subject Property) and legally described as follows: Lot One (1) in Northway Investment Subdivision of the North 480 feet of the East 931.36 feet (as measured parallel to the North and East lines thereof) of the Southeast ¼ of Section 23, Township 41 North, Range 11 East of the Third Principal Meridian, according to the plat thereof registered in the Office of the Registrar of Titles of Cook County, illinois on October 27, 1974 as Document Number 2902422, in Cook County, Illinois; and WHEREAS, the Petitioner seeks a Conditional Use to construct a 100-room hotel with a Variation to permit a thirty-nine (39') foot building height.; and WHEREAS, a Public Hearing was held on the request for Conditional Use being the subject of ZBA Case No. 17-98 before the Zoning Board of Appeals of the Village of Mount Prospect on the 22"d day of October, 1998, pursuant to proper legal notice having been published in the Mount Prospect Journal & Topics on the 7~ day of October, 1998; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees in support of the request being the subject of ZBA 17-98; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use for the construction of a 100-room hotel with a Variation for a thirty-nine (39') foot building height, as shown on the Site Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: That prior to the issuance of a building permit relative to the Conditional Use and Variation granted herein, the following conditions and/or written documentation shall be fulfilled: 1. Prior to issuance of a building permit, the Petitioner shall submit engineering and drainage plans meeting all requirements of the Development Code; BA 17-98 Page 2 of 2 2. Prior to building permit issuance, the Petitioner shall submit building plans meeting Fire Prevention Code requirements for sprinklers, standpipes, fire alarms and fire hydrants; 3. The Petitioner shall submit final landscaping plan meeting the requirements of Article XXlII of the Zoning Code and including the following additions: A. Provide screening material, either a masonry or wood fence or a continuous hedge a minimum of six feet high along the south property line, B. Provide additional landscape material in the form of shrubs and ornamental ground covers along the north and east property lines (adjacent to Elmhurst Road and Midway Drive). 4. The Petitioner shall provide appropriate signage and striping details for handicap accessible parking spaces; 5. The Petitioner shall provide a lighting plan and details of proposed fixtures; 6. The project shall be constructed in substantial compliance with the following plans: A. Site Plan prepared by Norman J. Toberman Associates, dated October 19, 1998, B. Elevations prepared by Nova Design Build, Inc., dated November 17, 1998. SECTION FOUR: That the Village Clerk is hereby authorized and directed to record a certified copy of this Ordinance with the Recorder of Deeds of Cook County. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
