VWL/ 8/26/98 8/27/98 ORDINANCE NO. 4961 AN ORDINANCE GRANTING EXCEPTIONS FROM THE DEVELOPMENT CODE (CHAPTER 16) FOR PROPERTY GENERALLY LOCATED AT 320 WEST CENTRAL ROAD WHEREAS, Henry W. Fdedrichs (hereinafter referred to as Petitioner) is the owner of the property generally located at 320 West Central Road (hereinafter referred to as Subject Property) and legally described as follows: Lot 1 of the Friedrichs Subdivision, being a Resubdivision in the West half of the Southwest Quarter of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, the Petitioner is requesting exceptions from Section 16. 403 and Section 16.408 of Chapter 16 (Development Code) of the Village Code of Mount Prospect to: 1. Reduce the required right-of-way on Elmhurst Avenue from sixty-six feet to fifty feet (Section 16.403.A.2); 2. Waive the required sidewalk installation on EImhurst Avenue (Section 16.403.A.9); 3. Waive the required installation of curbs and gutters on Elmhurst Avenue (Section 16.403.B.l.c); 4. Waive the requirement of a twenty-foot easement (Section 16.403.C.4.a); and 5. Waive the required parkway landscaping (Section 16.408.A.3). WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the request for exceptions from Sections 16.403.A.2, 16.403.A.9, 16.403.B.l.c, 16.403.C.4.a, and 16.408.A.3 of Chapter 16 (Development Code) for the Subject Property at their regular meeting on August 5, 1998, said request being the subject of PC-07-98 and by a unanimous vote recommended to the President and Board of Trustees of the Village to grant the exceptions from Chapter 16 as requested; and WHEREAS, the Plan Commission has forwarded their recommendation being the subject of PC~07-98 to the President and Board of Trustees of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. age 2 of 2 320 W. Central Road SECTION TWO: That the President and Board of Trustees of the Village of Mount Prospect do hereby grant to the Subject Property exceptions from Section 16.403 and Section 16.408 of Chapter 16 (Development Code) of the Village Code of Mount Prospect for the following: 1. Reduce the required right-of-way on Elmhurst Avenue from sixty-six feet, as set forth in Section 16.403.A.2, to fifty feet; 2. Waive the required sidewalk installation on Elmhurst Avenue, as set forth in Section 16.403.A.9; 3. Waive the required installation of curbs and gutters on Elmhurst Avenue, as set forth in Section 16.403.B.1.c; 4. Waive the requirement of a twenty-foot easement as set forth in Section 16.403.C.4.a; and 5. Waive the parkway landscaping requirements as set forth in Section 16.408.A.3, all as shown on the Site Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
