VVVL/ 8/10/98 8/13/98 ORDINANCE NO. 4957 AN ORDINANCE AMENDING ORDINANCE NO. 4592 GOVERNING THE PLANNED UNIT DEVELOPMENT FOR PROPERTY GENERALLY LOCATED AT 740 EAST RAND ROAD WHEREAS, Menard's, Inc. (hereinafter referred to as Petitioner) has filed a petition to amend the Planned Unit Development, being the subject of Ordinance No. 4592, with respect to property generally located at 740 East Rand Road (hereinafter referred to as the Subject Property), legally described as follows: Lot A in Reese's addition to Mount Prospect, a Subdivision of part of the northwest 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, containing 14.0333 acres, in Cook County, Illinois; and WHEREAS, the Petitioner seeks an amendment to the Planned Unit Development being the subject of Ordinance No. 4592, passed on October 19,1993, to allow construction of a new 160,380 square foot home improvement store; and WHEREAS, a public headng was held on the requested Planned Unit Development being the subject of ZBA Case No. 10-98, before the Zoning Board of Appeals of the Village of Mount Prospect on the 9 day of July, 1998, pursuant to proper legal notice having been th published in the Mount Prosoect Journal & ToPics on the 24 day of June 1998; and WHEREAS, the Zoning Board of Appeals has submitted its findings on the request to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the Planned Unit Development being the subject of ZBA 10-98 and have determined that the best interests of the Village of Mount Prospect will be served by the granting said Planned Unit Development. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That Ordinance No. 4592, passed and approved October 19, 1993, is hereby amended in order to allow construction of a 160,380 square foot home improvement store as shown on the approved Site Plan, attached as Exhibit "A". BA 10-98 Page 2 of 2 SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
