ORDINANCE NO. 4945
AN ORDINANCE AMENDING CHAPTER 22 ENTITLED
'WATER, SEWER, AND FLOOD PLAIN REGULATIONS'
OF THE VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That introductory Section 22.811 entitled "Variances" of Chapter 22 of the
Village Code of Mount Prospect, as amended, is hereby further amended by including the
following language, so that hereinafter said Section 22.811 of the Village Code of Mount
Prospect shall read as follows:
"Sec. 22,811. Variances. No variances shall be granted to any development
located in a regulatory floodway, as defined in Section 22.802,
nor shall the required compensatory storage as defined in Section 22.806 (B) (2),be
reduced to less than the amount of floodplain water storage volume displaced,
however, when a development proposal is located outside of a regulatory floodway, and
whenever the standards of this Article place undue hardship on a specific development
proposal, the Zoning Board of Appeals shall review the applicant's request for a variance and
shall submit its recommendation to the Village Board of Trustees."
SECTION TWO: That Section 22.811.A, Section 22.811.El, and Section 22.811 .C are in
no way affected by the introductory section as cited in SECTION ONE above;
SECTION THREE: That this Ordinance shall be in full rome and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
