HomeMy WebLinkAboutRes 60-99 12/21/1999HM 12/16/99 RESOLUTION NO. 60-99 A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION RELATIVE TO THE IMPROVEMENT OF ROUTE 83 BETWEEN PROSPECT AVENUE AND GOLF ROAD WHEREAS, the Corporate Authorities of the Village of Mount Prospect have determined that it would be in the best interests of the Village to participate with the State of Illinois Department of Transportation in sharing specific costs in conjunction with the improvement of Route 83 (Elmhurst Road) between Prospect Avenue and Golf Road; and WHEREAS, it has been further determined that it would be in the best interest of all concerned to enter into an agreement to share costs, in conjunction with the improvement of Route 83 (Elmhurst Road) from Prospect Avenue to Golf Road (the "Agreement"); and WHEREAS, the Agreement shall specify the portion of the cost that will be paid by the Village of Mount Prospect. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The Mayor is hereby authorized to sign and the Clerk is authorized to attest his signature on the Agreement between the Village of Mount Prospect and the Illinois Department of Transportation, being the subject of this Resolution, a copy of said Agreement is attached hereto and hereby made a part hereof as Exhibit "A". SECTION TWO: The authority to execute is specifically subject to the following: 1. The resolution, satisfactory to the Village Manager, of the issues set forth in the Glen Andler letter of December 14, 1999 attached as Exhibit "B". 2. TRANSPORTATION, heroinatter called the STATE, and the Village of Mount Prospect, County of Cook, of the State of Illinois, hereinafter called the VILLAGE. WITNESSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the motoring public, is desirous of improving approximately 1,898.32 meters (6,228.08 lineal feet) of Illinois Route 83 (Elmhurst Road), (FAP Route 344, State Section: (97B-R & 0405-1)R, State Job No.: C-91-033-93, State Contract: 82270, by making the following improvements: Widening, resurfacing and reconstructing Illinois Route 83 from approximately 186 meters (610.2 lineal feet) north of Illinois Route 58 (Golf Road) and extends in a northerly direction to U.S. Route 14, providing from north Of Illinois Route 58 to Prospect Avenue, 2-3.3 meters (10.8 foot) and variable through traffic lanes in each direction, from Prospect Avenue to U.S. Route 14 will provide 2-3.3 meters (11 foot) through traffic lanes in each direction, modemizing and combining traffic signals at the Illinois Route 83 intersections with U.S. Route 14, and at Prospect Avenue, modernizing .the traffic signals at Lincoln Avenue, Council Trail, Lonnquist Boulevard, and at U.S. Route 14 and Emerson Street, interconnecting signals, relocating emergency vehicle pre-emption, constructing new 1.21 meters (4 feet) to 2.1 meters (7 foot) PCC sidewalks throughout the project as needed, constructing curb and gutter and a storm sewer system for highway drainage, and by performing all other work necessary to complete the improvement in accordance with the approved plans and specifications. Illinois Route 83 at Wellers Creek' single span bridge (SN: 016-0559) will be removed and replaced with a steel beam structure, the existing out to out bridge width will be widened from 16.47 meters (54 feet) to 19.24 meters (63.12 feet) and variable, to provide 2-3.3 meters (10.8 foot) through traffic lanes in each direction, a 3.3 meter (10.8 foot) and variable width painted median with a 3.3 meter (10.8 foot) and variable width left turn lane at the Council Trail intersection, 2.1 meters (6.8 foot) sidewalks with a .3 meter (.9 foot) offset to the face of the sidewalk will be provided on both sides, and by performing all other work necessary to complete the bridge in accordance with the approved plans and specifications, the northbound traffic will be detoured; and WHEREAS, the northbound traffic will be detoured along Busse Road; and WHEREAS, the VILLAGE's watermain and sanitary sewer are in conflict with the improvement and must be relocated; and WHEREAS, the VILLAGE has requested the STATE's contractor to relocate the VILLAGE's watermain and sanitary sewer, and the STATE has agreed; and WHEREAS, the VILLAGE is desirous of said improvement in that same will be of immediate benefit to the VILLAGE residents and permanent in nature; NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The Village's cost shall be determined by multiplying the final quantifies times contract unit prices plus 10)~ for construction engineering and 5 ~ preliminary engineering. 2. The STATE also agrees to pay, or provide for the payment of, all fight of way, construction and engineering costs subject to reimbursement by the VILLAGE as hereina.Rer stipulated. 3. It is mutually agreed by and between the parties hereto that the estimated Cost o~ the improvement and cost proration is as shown on Page 2A (Pages I and 2). 4. The VILLAGE has passed a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto as Exhibit A and made a ' part hereof. Upon receipt of the first and subsequent progress payments made to the Contract°r' the VILLAGE will pay to the Department of Transportation of the State of Illinois from any funds allotted to the VILLAGE, an mount equal to the VILLAGE's share, $555,561, divided by the estimated construction cost, $4,615,300, multiplied by the actual progress payment (appropriately adjusted for nonparticipating costs on Federal projects) made to the Contractor until the entire obligation incurred under this Agreement has been paid2 The VILLAGE agrees to pass a 'supplemental resolution to provide necessary funds'for its share of the cost of this improvement if the amount appropriated herein Proves t~ be insufficient to cover said cost. 5. The VILLA GE has adopted, and will put into effect, prior to the State advertising for the work to he performed hereunder, an ordinance requiring that parking he prohibited, along Illinois Route 83 (Elmhurst Road) and/or U.S. 14 (Northwest Highway) within the limits of this improvement, within the VILLAGE limits, a copy of which is attached hereto as Exhibit B and made a part hereof, and will, in the future, prohibit parking at such locations within, or immediately adjacent to, this improvement, as may be determined by the STATE or be necessary from traffic capacity studies. -3- 6. The VILLAGE has adopted,, and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance prohibiting the discharge of sanitary sewage and industrial waste water into any storm sewers or drainage facilities constructed as a part of this improvement, a copy of which is attached hereto as Exhibit C and made a part hereof. 7. Prior to the STATE advertising for the work to be performed hereunder, the disposition of encroachments will be cooperatively determined by representatives from the VILLAGE and the STATE. The VILLAGE has adopted,, and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance relative to the disposition of encroachments and prohibiting in the future any new encroachments within the limits of the improvement, a copy of which is attached as Exhibit D and made a part hereof. 8. The VILLAGE agrees to adopt a resolution or send a letter, prior-to the STATE advertising for the work to be performed hereunder, approv/ng the. plans and specifications as prepared. 9.. The VILLAGE agrees not to permit driveway entrance openings to be made in the Curb as constructed, without the consent of the STATE. 10. The VILLAGE shall exercise its franchise right to cause private utilities to be relocated at no expense to the STATE. I1. The VILLAGE agrees to cause its utilities located on right of way acquired by the STATE or installed within the limits ora roadway after the said roadway was taken over for maintenance by the STATE, to be relocated and/or adjusted at no expense to the STATE. 12. All VILLAGE owned utilities, on STATE right of way within the limits of this improvement, which are to bo relocated/installed under the terms of this Agreement, will be in accordance with the "Accommodation of Utilities on Right of Way of the Illinois State Highway System" (92 Ill. Adm. Code 530). The VILLAGE agrees to obtain fxom the STATE, an approved permit for the watermalu, sanitary sewer and appurtenances, and to abide by all permit conditions associated 13. Upon completion of the improvement and final field inspection by the STATE, and so long as Illinois Route 83 is ~ as a STATE highway, the STATE agrees to maintain, or cause to be maintained, the through traffic lanes, the left mm lanes, and the curb and gutter or stabilized shoulders and ditches adjacent to those lanes. The STATE will be responsible for the maintenance of lane line and median line markings. 14. Upon final field inspection of the improvement, the VILLAGE agrees to maintain, or cause to bo maintained, those portions of the improvement which are not maintained by the STATE, including sidewalks, crosswalk, stopline markings on all effected highways, and maintenance of the mast arm cross street signing facing VILLAGE maintained streets, VILLA GE owned utilities, including all highway appurtenances thereto, and shall continue to maintain this section of roadway in accordance with the ongoing Maintenance Agreement between the VILLAGE and STATE signed July 21, 1995. -5- 15. Upon acceptance by the STATE of the lraffic signal work included herein, the financial responsibility for the maintenance and electrical energy charges for the operation of the signal(s) shall be proportioned as follows: Intersection Level of Maintenance Electrical ! It is further agreed that the signals shall be maintained to the Level of Maintenance shown above. -6- It is understood that Level Of Maintenance II exceeds the manual requirements and is prescribed for those signals that the District Engineer, with the concurrence of the Engineer of Operations, determines to require a higher level of service for adequate operations of the highway at those locations. The STATE agrees to make'arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The VILLAGE agrees to pay the entire cost as billed by the local power company The STATE retains the right to control the sequence and timing of the traffic signals. 16. Upon acceptance by the STATE of the traffic si~n~l moderuiz~tiun work included herein, the responsibility for physical maintenance shall be transferred from the VILLAGE to the STATE, financial responsibility for maintenance and energy shall continue to be as outlined in the Master Agreement executed by the STATE and the VILLAGE on March 3, 1982. 17. If in the future, the STATE adopts a roadway or traffic signal improvement on Illinois Route 83 and/or on U.S. 14 passing through the signal installation(s) included herein, which requires modernization or reconstruction to said installation, then the VILLAGE hereby agrees to be financially responsible for its proportionate share to modernize or reconstruct said signal installation(s) in conjunction with the STATE's proposed improvement. And hereby agrees to be financially responsible for all costs to relocate or reconstruct the emergency vehicle pre-emption equipment in conjunction with said project. 18. The STATE's Electrical Maintenance Contractor shall maintain the "Emergency Vehicle Pre-Emption System" equipment, located at the traffic signal installations to be maintained by the STATE. The STATE's Electrical Maintenance Contractor shall invoice the VILLAGE for the maintenance costs related to the maintenance of the "Emergency Vehicle Pre-EmPtion System" equipment. The VILLAGE shall maintain -7- the emitters and associated 'appurtenances at its own expense, The emitters shall be maintained and tested by the VILLAGE in accordance with the recommendations of the manufacturer. -$- Obligations of the STATE will cease immediately without penalty or further payment being required if, in any fiscal year, the Illinois General Assembly or Federal funding source fails to appropriate or otherwise make available funds for this contract. THIS AGREEMENT, and the covenants cont~i~ed herein, shall become null and void in the event the contract covering the construction work contemplated herein is not awarded within 3 years Subsequent to execution of this Agreement.
