The Subject Property is zoned B-5 Central Commercial, and is located n the southeast corner of Prospect Avenue and Pine Street. Commissioner Beattie introduced case, PZ- 19-19 139-143 W. Prospect Avenue Suite 201 as a Conditional Use to allow a massage therapy establishment.This case is Village Board final. Mr. Harmon gave a brief description of the Subject Property and explained the proposed massage therapy establishment would occupy the 2nd story of an existing commercial strip center.The space is 350 square feet and ►mould consist of an office space, massage area space, and bathroom.The hours of operation would be Monday, Wednesday, and Friday from 10 AM to 6 PM,Tuesday and Thursday 10 AM to 4 PM, and would be closed Saturday and Sunday. Mr. Harmon stated that no additional parking would be required if the conditional use was approved, and that the one massage therapist employee is licensed with the State. Mr. Harmon stated that Staff has reviewed the Petitioner's request for a massage therapy establishment and feels that it meets the standards for a conditional use. The proposed massage therapy use complies with the Comprehensive Plan and sufficient parking is provided on site. Planning&Zoning Commission Meeting-September 12,2019 PZ-19-19 Joseph Donnelly,Chair 2 Mr. Harmon stated that Staff finds that the conditional use complies with the standards as listed in the Zoning Ordinance and that granting such a request would be in the best interest of the Village. Staff recommends that the Planning ,& Zoning Commission make a motion to adopt staff's findings as the findings of the Planning and Zoning Commission and recommends AppLovalof the following motion: 1 "To approve: 1. A conditional use to operate a massage therapy establishment at 139-143 W. Prospect Avenue Suite 201." He stated the Village Board's decision is final. Mr. Harmon also stated that the Petitioner currently operates a massage therapy establishment in town, and wishes to continue operating in Mount Prospect in a new space. Commissioner Beattie asked if there was any buildout or interior remodel associated with the request. Mr. Harmon stated that there is not a buildout or interior remodel associated with the request. Commissioner Beattie swore in Vicktoria Jimenez, 1 N. Hamilin, Park Ridge, Illinois. Ms.Jimenez stated that she currently operates a massage therapy establishment, and that is has come necessary to move to a new space, and wishes to continue doing business in Mount Prospect. Ms.Jimenez then stated that the space will suffice as is, and will not require additional interior changes. She stated that parking will not be an issue. BACKGROUND/PROPERTY HISTORY The Subject Property is part of an existing varying one and two-story strip center that was annexed into the Village in 1917 and consists of various commercial spaces facing West Prospect Avenue. There are eleven parcels, which make up the strip center. The Subject Property is known as 139-143 W. Prospect and is the northwestern most parcel. PROPOSAL The Petitioner proposes to locate a massage therapy establishment on the Subject Property, which requires conditional use approval. The business would occupy space on the second floor, above Mia's Cantina. The proposed hours of operation will be from 10 am-6 pm Monday, Wednesday, and Friday, and 10 am-4 pm, Tuesday and Thursday. The business will be closed Saturday and Sunday. There will only be one licensed employee within the establishment. Par - According to the Village Code, parking is required for spaces in excess of 2,500 square feet of floor area in the B-5 Central Commercial District. CONDITIONAL USE STANDARDS The standards for conditional uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance and include seven specific findings that must be made in order to approve a conditional use. The following list is a summary of these findings: o The conditional use will not have a detrimental impact on the public health, safety, morals, comfort or general welfare; The conditional use will not be injurious to the use, enjoyment, or value of other properties in the vicinity or impede the orderly development of those properties; Adequate provision of utilities, drainage, and design of access and egress to minimize congestion on Village streets; and Per the Petitioner, the business has been in operation for 13 years, 4 of which have been in Mount Prospect,, and to date has not been detrimental or endangering toward the community. The Petitioner states that the business will be completely within its own office, will not affect public utilities, access roads, or drainage. The Petitioner further states the use is not contrary to the objectives in the current Comprehensive Plan and that their business conforms to applicable regulations. Village staff has reviewed the Petitioner's request and feels that it meets the standards for a conditional use. The proposed massage therapy establishment will consist of one massage therapist licensed with the State of Illinois. The proposed massage therapy use would be consistent with the Comprehensive Plan Downtown Mixed-Use land use classification. Staff does not feel the proposed use would have a detrimental impact as the small space would generate a low volume of traffic. 2 Staff finds that the conditional use complies with the standards as listed in the Zoning Ordinance and that granting such a request would be in the best interest of the Village.
