one (1) Modi Restaurant Group Inc., d/b/a Photos Hotdogs located at 1706 E. Kensington
Road, Mount Prospect, IL]

Information:
Modi Restaurant Inc. d/b/a Photo's Hotdogs located at 1706 E. Kensington closed their business February 5, 2018.
New owners have come forward to lease the store front with possible intentions of a restaurant. Mount Prospect liquor
code 13.208D states:
Any licensed establishment that has discontinued the sale or service of alcoholic beverages or that has not been open
for business at least four(4) days per week for a period of thirty (30) days or more shall automatically forfeit its
license. This forfeiture shall not apply in instances where the licensee has previously notified the Village Manager, in
writing, of an intent to close the premises for a portion of a license term for remodeling or other similar purpose.

1. Approve ordinance decreasing the number of Class 7-2" liquor licenses by one (1).
2. Action at discretion of Village Board.
Staff Recommendation
Staff recommends approval so as to maintain an accurate number of liquor licenses.

AN ORDINANCE AMENDING CHAPTER 13 OF THE
VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT
PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: That in accordance with Subsection A of Section 13.108 of Chapter 13 of the Village Code of
Mount Prospect, as amended, the Corporate Authorities shall determine the number of Liquor Licenses
available in each Classification and shall establish a list specifying the number of Liquor Licenses authorized.
Said list is hereby amended by decreasing the number of"Class F-2" Liquor License by One (1) MODI
RESTAURANT INC.,d/b/a PHOTO HOT DOGS LOCATED at 1706 e. KENSINGTON ROAD Said list is as
follows:
Five (5) Class P-1 License
Ten (10) Class P-2 Licenses
One (1) Class P-3 Licenses
Zero (0) Class P-4 Licenses
Zero (0) Class P-5 License
Eleven (11) Class F-1 License
Eight(8) Class F-2 License
Twenty eight (28) Class F-3 License
One (1) Class F-4 License
Three (3) Class F-5 License
Two (2) Class F-6 License
One (1) Class F-7 License
One (1) Class S-1 License
One (1) Class S-2 Licenses
One (1) Class S-31-icenses
Zero (0) Class S-41-icense
