Pursuant t the findings discussed in the 2017 Water Rate Study, this years proposed project is scaled to continue a multi-year process of reducing life expectancy of waterm ins to 130 years. The improvement will increase the reliability and sustainability of thew ter distribution system. Analysis performed during the Water Rate Study indicated that our former rate of renewal approached 600 years. This project includes replacing lineal feet of six-inch " diameter water main with " diameter class 56 ductile iron water main. The project area is depictedn the attached map (Attachment ). Streets affected include Lane., Mark Drive, Thayer Street,, Mitchell Drive and Jeffry Drive. The class 56 ductile iron water main will be installed in open cut trenches under the eastern drive lane of the street on Yatesn under both drive lanes on Mark Drive, Thayer Street,, Mitchell Lane and Jeffrey Drive. In addition the " water main installation, the project also includes approximately 368 lineal feet of stormsewer replacement; ten ( ) new water main valves and vaults; ten ( ) new fire hydrants; Sixty-four ( ) water servicer connections and various pavement and parkway restorations. The work will be constructed in accordancewith the 2019 Water Main I cement Documents (Attachment B). Bid Robinsoniri prepared it plans, specifications and biddingdocuments necessary to facilitate contractual performance of this work. A copy of the bid documentsand project plans are attached (Attachment ). https://go.boarddocs.com/il/vomp/Board.nsf/Private?open&login# 1/3 7/16/2019 BoardDocs®Pro The bid documents were sent to fourteen (14) area firms who have experience in water main replacement projects and to all firms that previously bid on past water in replacement projects. The work was publicly advertised on the Village's website. On July 8,, 2019 the bids were publicly opened and read as required by Village Code. Discussion All bids were reviewed to ensure that the documents had all appropriate signatures, and bid security. All bids were submitted with requisite documents, security., and signatures except for Millennium Contracting Corporation of Chicago,, Illinois (Millenium). Millennnium failed to sign and submit the three (3) addendu that were publicly advertised as required. A copy of the adden are attached (Attachment Q. The apparent lowest cost bid was submitted by Millenium. The firm has never performed work for the Village of Mount Prospect in the past. The specifications required submittal of a minimum of three (3) references for projects of similar scale and scope. Millennium provided three (3) references for water main construction projects. However, all three (3) references were for work performed as a sub-contractor. All the references were other contractors including Reliable Contracting Company of Chicago, NPL Construction Company of Chicago, and Benchmark Construction Company of Bartlett. They provided no municipal or water agency references. one of the referenced contractors have previously performed work for the Village of Mount Prospect. Staff called all three (3) references and received favorable feedback from two (2) firms. However, one (1) of the references shared the same surname as the president of Millennium. The third reference did not return our call. Staff also contacted Millennium directly to discuss their experience and resources in greater detail. We specifically asked the firm to supply references for water main work performed as a prime contractor for a municipality or public water agency. Millenium stated that they do not have that type of work experience. Furthermore, the firm seems to have no experience securing bonding for construction projects. Inaddition to the bid bond, this project requires a performance bond, labor and materials payment bond, and a two-year maintenance bond. To date, it appears most of their work has been performed as a subcontractor. Furthermore, most of their work sites have been in the City of Chicago. Finally, a portion of Millenium's bid submittal is materially unbalanced. Their submittal for full-depth (11-inch) pavement patches over thew ter in trenches is $9.23 / square yard. The engineer's estimate for this work is $60 / square yard. The average of prices received for this work item is $58.86 / square yard. When queried,, Millienium responded that their submitted unit cost was erroneous. Their actual cost for this work is $33 / square yard which increases the total cost for this work item from $45.,503.90 to $162,690. It also increases Millenium's total bid price from $1,254,577.89 to $1,361,763.99. Due to a lack of relevant experience, inadequate work references, incomplete bid submittal, and a material error in their bid submittal, staff has concluded that Millenium's bid is non-responsive to the bid documents. Based on the review of the bids, reference checks and past projects, the next lowest-cost, responsible bidder is Patnick Construction, Inc. of Franklin Park! Illinois (Patnick). Patnick has performed work for the Village in the past. Most recently, they constructed the 2018 Water Main Replacement Project on Prospect Ave,, School Street, Lincoln https://go.boarddocs.com/il/vomp/Board.nsf/Private?open&login# 2/3 7/16/2019 BoardDocs®Pro Street and Maple Street. Work on the project was completed satisfactorily. In addition, reference checks indicated that Patnick has satisfactorily completed similar work in other communities. It is the opinion of staff that Patnick is qualified to successfully prosecute this proposed project. Patnick's bid submittal is attached (Attachment D). On the advice of the Village Attorney, staff recommends that the Village Board waive the requirements for public bidding in this instance and award a contract for the 2019 Water Main Replacement Project to Patnick Construction, Inc. of Franklin Park/ Illinois. Since the project includes underground work, there is a possibility of unforeseen repairs. Staff is requesting a 10% contingency ($142,,344.25) to address any of these unforeseen issues should they arise. A 10% contingency would bring the project award total to $1,565,786.75 (the $1,,423.,442.50 base bid plus the 10% contingency of $142.,344.25). Alternatives 1. Supervision. The contractor shall at all times have a competent person in charge of its work crew at the job site to whom the Village representative may issue directives. Such person shall be authorized to accept and act upon such directives. Such person shall be fluent in the English language. q. Traffic Control. Contractor shall maintain traffic flow(s) and accessibility to private property(s) as close to normal condition as possible. Contractor shall notify residents, Village of Mount Prospect and state/county officials, as appropriate, of any driveway or road closure. The contractor shall abide with the Illinois Department of Transportation's Standard Specifications for Road and Bridge Construction, latest edition. The Contractor shall also abide with the Manual on Uniform Traffic Control Devices, latest edition. Contractor shall also provide sufficient flag persons to assist with traffic control during operation. Traffic control costs to close the street or ROW is to be included in the "all- inclusive" unit price of the pay item and considered as incidental to that pay item and will not be considered an extra line item. r. Tree Protection. All tree protection shall be incidental to the contract and shall be installed and maintained in accordance with the Tree Protection Ordinance and plan as specified by the Village. REMOVAL PROHIBITED UNLESS AUTHORIZED: All trees shall be maintained, saved, and protected from damage unless removal is approved by the Village. CRITICAL ROOT ZONE: To prevent unnecessary damage to existing public trees during construction, proper tree protection guidelines must be followed, particularly in the root zone where major support roots securely hold the tree in the soil. This Critical Root Zone (CRZ) is defined as the entire ground area within the vertical projection of the crown of a tree. This is also commonly referred to as the area within the drip line of a tree. Power equipment may not be used to excavate soil, change grades, or dig trenches in the Critical Root Zone. All soil excavation done within the CRZ must be done by hand, except as authorized in these specifications. Exceptions to the above shall be granted only with written permission from the Director of Public Works. FENCING: All unpaved ground on public property within the Critical Root Zones (CRZ) of existing trees subject to construction damage shall be fenced before any work is started. This Tree Protection Fencing will be paid for as specified in these contract documents. Once assembled, no fencing shall be removed without prior approval of the Engineer, and there shall be no construction activity or material including storage, stockpiling, and equipment access within the enclosure. Fencing material shall be orange polypropylene snow fence supported with metal posts, and installed according to the detail which will be provided by the Forestry Division. 20 Yates Lane Water Main Replacement CHANGES TO EXISTING GRADE: No changes to original grade shall be allowed inside the CRZ. ROOT PRUNING DURING CONSTRUCTION: All tree roots greater than two inches (2") in diameter that are encountered in any construction process shall be cut cleanly with an appropriate saw or pruning shear or other tool specifically designed for cutting wood. Axes or other such chopping tools shall not be used. Shovels or other tools designed for digging shall not be used. Contractor shall contact Forestry for a root inspection before backfilling. Root pruning shall not be paid for separately but shall be considered incidental to the Contract. ATTACHMENTS TO TREES: No signs, placards or other objects may be nailed or stapled to trees. BRANCH REMOVAL: Tree branches shall not be cut, pruned or trimmed by the Contractor. If parkway tree branches interfere with the Contractor's work, he should contact the Forestry Division to request pruning. If Forestry deems the request reasonable they will endeavor to promptly prune the branches at the Village's expense. PENALTIES FOR TREE DAMAGE: Where limbs, trunks or roots of trees not approved for removal are damaged, the Village shall determine whether the tree can be repaired or must be removed. Repairs may include, but are not strictly limited to, pruning of broken limbs, removal of loose bark and proper shaping of wounds, thinning of the crown to compensate for root loss, fertilization, straightening and staking. Repairs shall be performed by the Village. The cost of such repairs shall be paid for by the Contractor to the Village, using rates listed in the current edition of the Village's Equipment and Labor Rate Charges. Additionally, the Village may fine the contractor for unnecessary tree damage according to the schedule listed in Appendix A, Division III of the Village Code. If in the opinion of the Village, the amount of damage warrants removal of the tree due to safety or aesthetic concerns, the Contractor shall remove the tree, along with its stump to a depth of 12 inches below grade. The Contractor shall pay the Village for replacement of the tree. Replacement cost will be determined by multiplying the diameter of the damaged tree, as measured 4-1/2 feet above the ground, by the rate of $150.00/inch. The Contractor shall be responsible for being familiar with and complying with all aspects of the Village of Mount Prospect Tree Protection ordinances and Arboricultural Standards Manual as they relate to the various site locations. Any questions regarding tree protection shall be directed to the Village Forestry Division and their response or direction shall be considered as the final word/decision on tree protection issues. CLARIFICATIONS Question:Are there soil borings available? Response: Soil borings are not available for this project. Question: Can the unit of measurement for Trench Backfill be changed to Cubic Yard? Response: The unit of measurement cannot be changed, please bid project as designed. All trench backfill on the project will be paid for per Foot of trench as specified in the Special Provisions. Question: Can water service&b-box be terminated in the parkway in lieu of the sidewalk? Response: All proposed b-boxes for water services shall be installed in the parkway as indicated on the plans. Sidewalk removal may be necessary to disconnect service from existing b-box and to abandon existing b-box. If sidewalk removal is required, it shall be considered incidental to the water service pay item. Question: Why is restoration incidental to the water service pay items? Does restoration for water services include sidewalks, driveways, street patching, curb removal and replacement? What if a water service needs to be installed differently than shown on the plans?What are the restoration items in the contract for? Response: It is the intent to minimize disturbance and measurement minutiae by making all restoration incidental to water services. Restoration for water services include, sidewalk removal and replacement, patching and curb&gutter removal and replacement. Driveway removal and replacement will be paid for separately as indicated in the Special Provisions. The proposed water service locations shown on the plans are recommended only,the Contractor shall be familiar with the project site and shall install water services as he sees fit in the field. It is also the intent to avoid arguments over minuscule quantities by making all restoration incidental to water services installation. Response:A water truck shall be used to spread water for dust control. The Contractor will be able to fill up water at Public Works or obtain a fire hydrant meter from the Village upon request. Response:The existing pavement thickness is unknown.The Village standard is an eleven-inch(11")patch as shown in the Pavement Restoration Detail. Question: Can the water main trench on Yates Lane be left six inches(6")low if it is barricaded off? Response: The Contractor shall backfill Yates Lane to final grade elevation and shall remove the trench backfill in preparation for pavement patching. The Contractor may use asphalt grinds for temporary backfill. Leaving the water main trench low and barricading during non-working hours will not be allowed.
