ELMHURST ROAD,, MOUNT PROSPECT, ILLINOIS The Petitioner ,, David and Susan Petkovich of Park View Montessori School, Inc., propose to locate a daycare center al -I 1000 - 1080 S. Elmhurst Drivecommonly known as Golf Plaza II Shopping Center (the "Subject Pr••- ' •p- ocated on the southwest corner of Golf Road and Elmhurst Road, is zoned B-3 Commercial and consists of a 148,613 square foot shopping center of which 11,409 square feet is proposed to be developed as a daycare center. The proposed daycare center requires conditional use approval. The daycare center would occupy a currently vacant space located at the south end of the shopping center ,, which was formerly occupied by Alexian Brothers. Park View Montessori has been providing care for children aged 6 weeks through 6 years in Mount Prospect since 1976. The proposed hours of operation will be from 6:30 AM to 6:00 PM. The Petitioner states that the business will have 20 employees and the Department of Children and Family Services (DCFS) licensing capacity will be between 115 and 125 children. Drop off times will be spread out between 6:30 AM to 9:00 AM and pick up times will be between 3:00 PM and 6:00 PM. Dee's Catering Service will provide 2 - 3 snacks per day and lunch. The Village Code requires a total of 595 parking spaces be provided on-site for the shopping center. The Petitioner is proposing to create 11 stalls behind the shopping center while removing 7 stalls to facilitate the installation of a playground on the south side of the building, bringing the total provided on the Subject Property to 597. The interior of the space will need to be modified to satisfy egress and life safety regulations, and a trash enclosure will need to be relocated. ELMHURST RD. / CONDITIONAL USE FOR A DAYCARE CENTER BACKGROUND A public hearing has been scheduled for the April 25, 2019 Planning and Zoning Commission meeting to review the application by David and Susan Petkovich of Parkview Montessori School, Inc. (the "Petitioner") regarding the property located at 1000 — 1. 0 8 0 S. Elmhurst Road (the "Subject Property"). The Petitioner has requested conditional use approval to allow for a daycare center. The P&Z hearing was properly noticed in the April 10, 2019 edition of the Daily Herald Newspaper. Staff completed the required written notice to property owners within 250 feet and posted a public hearing sign on the Subject Property. PROPERTY DESCRIPTION The Subject Property is located at the southwest comer of Elmhurst Road and Golf Road and is zoned B Community Shopping. The Subject Property is bordered by the RI Single Family Residential District to the nort and west, an R4 Multi -Family Development PUD and B3 Community Shopping PUD to the south, and the Mark Place shopping center in Des Plaines to the east. The Sub ect Property contains a multi -tenant shopping center known as Golf.Plaza 11. Current businesses locate in the center include Hair Cuttery, Little Caesar's, Gamestop, Walgreen's, The Ball Factory, Crystal Palace, K Market and more. The Subject Property also includes two outlot buildings, which have Bank of America and Bosto The Petitioner proposes to locate a daycare center on the Subject Property, which requires conditional use approval. The daycare center would occupy a currently vacant space located at the south end of the shopping center, which was formerly occupied by Alexian Brothers. The two out -lot buildings and their associated parking was not included in the parking requirement calculations as they are on separate parcels which can be bought and sold separately. APPROVAL STANDARDS The standards for conditional uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance and include 7 specific findings that must be made in order to approve a conditional use. The following list is a summary of these findings: 0 The conditional use will not have a detrimental impact on the public health, safety, morals, comfort or general welfare; 0 The conditional use will not be injurious to the use, enjoyment, or value of other properties in the vicinity or impede the orderly development of those properties; 10 Adequate provision of utilities, drainage, and design of access and egress to minimize congestion on Village streets; and Per the Petitioner, the proposed dayeare center will not have a detrimental impact or be injurious to surroundin properties. The Petitioner states the business will serve the community, increasing property values nearby. Th Subject Property consists of an existing shopping center, therefore site utilities and drainage are already in plac Public health, safety, and general welfare will be improved by this use as it would provide a safe environment fo children. Per the Petitioner, no properties in. the vicinity will be harmed by this use. I Staff has reviewed the Petitioner" s request for a dayeare center and feels that it meets the standards for a conditional use. The proposed daycare center use complies with the Comprehensive Plan and sufficient parking is provided on site. The Village's Comprehensive Plan designates the property's future use as corridor commercial. The corridor commercial district provides for large format retail, restaurant, and other commercial uses. Secondary uses include medical, entertainment, hotel, and office uses. Staff does not feet the proposed use would have a detrimental impact on surrounding properties or other commercial activity on the Subject Property. The proposed use will not be a detriment or endanger the welfare of the general public. RECOMMENDATION Staff finds that the conditional use complies with the standards as listed in the Zoning Ordinance and that granting such a request would be in the best interest of the Village. Chairman Donnelly called the meeting to order at 7:02 pm. Commissioner Fitzgerald made a motion seconded by Commissioner Filippone to approve the minutes from the Planning and Zoning Commission meeting on March 14, 2019. The minutes were approved 5-0. Chairman Donnelly introduced case, PZ -08- 19 Park View Montessori School. This case is Village Board Final. Commissioner Filippone excused himself from the case due to a professional conflict and sat in the audience. Mr. Shallcross gave a general description of the Subject Property stating that it contains a multi -tenant shopping center known as Golf Plaza II. He gave a brief explanation of the Conditional Use request stating that the Petitioner proposes to locate a daycare center on the Subject Property. Mr. Shallcross gave a brief explanation of the proposed floor plan and stated that the proposal would create eleven parking stalls behind the shopping center bringing the total amount provided on the site to 597. Mr. Shallcross stated that Staff has reviewed the Petitioner's request for a daycare center and feels that the standards for a Conditional Use have been met. Planning and Zoning Commission Meeting- April 25, 2019 PZ -08-19 Joseph Donnelly, Chair 2 Mr. Shallcross stated that Staff finds that the conditional use complies with the standards as listed in the Zoning Ordinance and that granting such a request would be in the best interest of the Village. Staff recommends that the Planning & Zoning Commission make a motion to adopt staff's findings as the findings of the Planning and Zoning Commission and recommends approval of the following motion: "To approve: 1. A conditional use permit for a daycare center at 1000 — 1080 S. Elmhurst Road, Case No. PZ -08- 19, subject to the following conditions: a. Compliance with all Development, Fire, Building, and other Village codes and regulations; and b. Development of the site in general conformance with the site plan prepared by ALA Architects & Planners, Inc. dated April 9t", 2019." He stated that the Village Board's decision is final for this case. Commissioner Fitzgerald asked if the shopping center had cleared up the property maintenance issues on the site not relevant to this proposal. Mr. Shallcross stated that the property is a work in progress and is in compliance. Chairman Donnelly swore in David Petkovich and Kelly 1060 S. Elmhurst Road. Kelly gave a brief history of Park View Montessori School and stated that they have been in the Village of Mount Prospect for over 43 years and their current space at 805 Burning Bush is being taken over by the River Trails School District. They want to keep the Montessori School in the Village and have found the Subject Property to fit their needs. After hearing no further comments Commissioner Fitzgerald made a motion seconded by Commissioner Mizwicki to approve the following motion: "To a pp rove: 1.
