Public Content Information To assure that high quality asphalt and concrete materials are utilized by contractors in this year's street resurfacing and sidewalk improvement programs, the Public Works Department requires the services of a materials testing consultant. To procure these services, staff prepared and distributed a detailed request for proposals (RFP). copy of this document i attached. Tasks defined in the scope of work included: 1. Project Management/Report Review 2. Engineering Technician . Vehicle Charge 4. Cylinder pickup 5. Compression Testing per cylinder 6. Nuclear Density Gage Usage 7. Maximum Theoretical Specific Gravity 8. Bulk Specific Gravity 9. Ignition oven test/Reflux extraction and sieve analysis ResultsRFP The consultants' proposals were reviewed on the basis of their understanding of Village goals and their testing methodologies. They were rated (with a maximum score of 100 points) according to these specific categories: background, experience, scope of work proposed, schedule, work effort, proposal content, and cost. They are prequalified by IDOT to perform this work and have the capability to respond to our specific project needs. They have successfully performed these same services for numerous communities in recent years and received positive references from those communities. Rubino Engineering, Inc. provided these services to the Village for 8 years(2009 to 2016). Applied Geoscience, the Village's materials testing service provider last year, submitted the lowest cost proposal but was not selected for performance reasons. Notably, performance last year was below average. Specifically, concrete cylinders were not picked up in a timely fashion and laboratory analysis reports were often late. Staff is concerned that delays like these cloud the chain of control and could lead to problems correcting defects if laboratory analyses indicate poor quality. It is Village staffs opinion that Rubino Engineering, Inc. will provide high quality material testing services at a reasonable cost. The services listed in the proposal are based on estimated jobsite work hours using averages from previous years and prorated for the anticipated work for this year. Many factors can influence the actual jobsite work hours for quality assurance testing. In order to allow for contingencies and the possible need for additional testing, staff recommends that the contract award include a 10%contingency($35,056+$3,505=$38,561.00). Alternatives 1. Accept Rubino Engineering, Inc. proposal to provide materials testing services for 2019 Street Resurfacing and Sidewalk Improvement Programs. 2.Action at discretion of Village Board. Overtime rates are applicable for services performed in excess of 8 hours per day Monday through Friday, before 7:00 AM or after 3:00 PM, 3) and for all hours worked on Saturdays,Sundays and holidays.The overtime rate is 1.5 times the applicable hourly rate. Services cancelled without advance and/or inadequate notice will be assessed a minimum 4-hour charge. 10) For all Rubino Engineering, Inc.services,a project,management/engineering review charge will be billed for all reports issued for the scheduling/supervision of personnel and the evalruationlreview of data and reports. 11) The minimum billing increment for time is a half hour, 12) A project set-up charge of a minimum of two hours applies to all projects. 13) Professional Services rates are exclusive of expert deposition or testimony time. "Work"means the specific geotechnical, analytical,testing or other service to be performed by Rubino Engineering,Inc.,as set forth in Rubino Engineering,Inc's proposal,Client's acceptance thereof and these General Conditions., Additional work ordered by Client shall also be subject to these General Conditions, "Client"refers to the person or business entity ordering the work to be done by Rubino Engineering,Inc.. If Client is ordering the work on behalf of another,Client represents and warrants that it is the duly authorized agent of said party for the purpose of ordering and directing said work. Unless otherwise staled in writing,Client assumes sole responsibility for determining whether the quantity and the nature of the work ordered by the client is adequate and sufficient for Client's intended purpose. Client shall communicate these General Conditions to each and every third party to whom Client transmits any part of Rubino Engineering,Inc's work. Client further agrees to pay interest on all amounts invoiced and not paid or objected to for valid cause in writing with said thirty(30)day period at the rale of eighteen(16)percent per annum(or the maximum interest rate permitted under applicable law),until paid Client agrees to pay Rubino Engineering,Inc's cost of collection of all amounts due and unpaid after sixty(60)days,including court costs and reasonable attorney's fees. Rubino Engineering,Inc.shall not be bound by any provision or agreement requiring or providing for arbitration or disputes or controversies arising out of this agreement,any provision wherein Rubino Engineering,Inc waives any rights to a mechanics'lien,or any provision conditioning Rubino Engineering,Inc's right to receive payment for its work upon payment to Client by any third party. In the event that Client or Client's principal shall bring any suit,cause of action,claim or counterclaim against Rubino Engineering,Inc,the party initiating such action shall pay to Rubino Engineering,Inc the costs and expenses incurred by Rubino Engineering,Inc to investigate,answer and defend it,including reasonable attorney's and witness fees and court costs to the extent that Rubino Engineering,Inc,shall prevail in such suit.. 11.TERMINATION: This Agreement may be terminated by either party upon seven(7)days'prior written notice, In the event of termination,Rubino Engineering,Inc shall be compensated by Client for all services performed up to and including the termination date,including reimbursable expenses and for the completion of such services and records as are necessary to place Rubino Engineering,Inc's files in order and/or protect its professional reputation 12.EMPLOYEES/WITNESS FEES: Rubino Engineering,Inc,'s employees shall not be retained as expert witnesses except by separate written agreement. In the event Client hires a Rubino Engineering,Inc,employee,Client shall pay Rubino Engineering,Inc an amount equal to one-half of the employee's annualized salary,with Rubino Engineering,Inc waiving other remedies it may have 13.HAZARDOUS MATERIALS: Nothing contained within this agreement shall be construed or interpreted as requiring Rubino Engineering,Inc,to assume the status of an owner,operator,generator, storer,transporter,treater or disposal facility as those terms appear within RCRA of within any Federal or State statute or regulation governing the generation,transportation,treatment,storage and disposal of pollutants, Client assumes full responsibility for compliance with the provisions of RCRA and any other Federal or State statute or regulation governing the handling,treatment,storage and disposal of pollutants.. 14.PROVISIONS SEVERABLE: The parties have entered into this agreement in good faith and it is the specific intent of the parties that the terms of the General Conditions be enforced as written.. IDOT Manual of Test Procedures for Materials (12/1/2018). • As part of Jobsite QA, the Consultant will provide an individual to act as the QA Manager. The QA Manager will have at a minimum a HMA Level II Technician certification and PCC Level II Technician certification. • Services will be required from approximately April 1, 2019 to December 1, 2019. • Field Inspection hours will begin when the Engineering Technician arrives on the jobsite; inspection hours will end once testing is complete and the technician leaves the jobsite. The Engineering Technician shall not exceed 8 hours on site, unless written permission is obtained from the Village. The Consultant shall submit a field trip ticket to the Village to verify hours on the jobsite. • The cost for Cylinder Pickup shall include all labor, vehicles, and materials necessary to travel to the jobsite, retrieve test cylinders, and deliver the cylinders to the lab. • Each PCC compressive strength test gathering shall consist of casting four, 6-inch diameter concrete cylinders. The Consultant shall test two of the cylinders 7 days after casting, and test the remaining two cylinders 14 days after casting. The Consultant shall submit final PCC reports to the Village no later than 7 days after the 14-day compressive strength test. The Village reserves the rights to accept or reject any and all proposals, to waive any informality in any proposals, and to accept any proposals considered advantageous to the Village.
