HomeMy WebLinkAboutOrd 5022 05/18/1999 ORDINANCE NO. 5022 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP WITH RESPECT TO THE ZONING OF CERTAIN PROPERTY FROM R-A AND R-1 TO B-3 (COMMUNITY SHOPPING) DISTRICT 512 & 600 EAST RAND ROAD Passed and approved by the President and Board of Trustees the 18th day of May, 1999 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 19th day of May, 1999 VWL/ 5/7/99 5/12/99 5113199 ORDINANCE NO. 5022 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP WITH RESPECT TO THE ZONING OF CERTAIN PROPERTY FROM R-A AND R-1 TO B-3 (COMMUNITY SHOPPING) DISTRICT (512 & 600 EAST RAND ROAD) WHEREAS, Northwest Property, L.L.C. is the owner of property commonly known as 512 and 600 East Rand Road (hereinafter referred to as Subject Property); and WHEREAS, the Subject Property is legally described as follows: Parcel 1: Lot A in Woodock's Subdivision of the South 242 feet except the North 100 feet thereof measured on the East line of the South 242 feet of that part of the Southeast % of the Northeast ¼ of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, lying Easterly of the center line of Rand Road except the East 75 feet of the South 77 feet of the land fronting 125.77 feet on Easterly side of Rand Road in Cook County, Illinois. Parcel 2: The South 33 feet measured along the East line of that part of the Southeast ',4 of the Northeast ¼ of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, lying Easterly of the center line of Rand Road (except the East 75 feet thereof in Cook County, Illinois. Pamel 3: That part of the North 100 feet as measured along the East line of the South 242 feet of that part of the Southeast ¼ of the Northeast ¼ of Section 34, Township 42 North, Range 11, lying easterly of the center line of Rand Road (except that portion used for road purposes), East of the Third Principal Meridian in Cook County, Illinois. Together with: Outlots 11 and 12 in Kensington Center, Phase 1, being a subdivision in the East ¼ of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois; and WHEREAS, Thomas Reindl, representing Northwest Property L.L.C., (hereinafter referred to as Petitioner) has filed an application to rezone the Subject Property from R-A and R-1 (Single Family Residence) to E~-3 (Community Shopping); and WHEREAS, a public hearing was held on the request for rezoning, being the subject of ZBA Case No. 10-99 before the Zoning Board of Appeals of the Village of Mount Prospect on the 22°d day of April, 1999 pursuant to due and proper notice thereof having been published in the Mount Prospect Journal and ToDics on the 7th day of April, 1999; and age 2/2 NW Electric WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations relative to ZBA 10-99 to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered the request being the subject of ZBA 10-99 and have determined that the best interests of the Village of Mount Prospect would be served by granting said request. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECT'ION TWO: The official zoning map of the Village of Mount Prospect, Illinois, as amended, is hereby further amended by reclassifying the property being the subject of this Ordinance from R1 and R-A (Single Family Residence) to B-3 (Community Shopping) District as shown on the attached Site Plan, prepared by Randall Bees Architects, dated April 5, 1999, a copy of which is attached hereto and hereby made a part hereof as Exhibit "An. SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
