HomeMy WebLinkAboutOrd 5021 05/18/1999 ORDINANCE NO. 5021 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE VILLAGE OF MOUNT PROSPECT AND GRANTING A CONDITIONAL USE AND VARIATIONS TO PROPERTY COMMONLY KNOWN AS 2107 SOUTH BUSSE ROAD Passed and approved by the President and Board of Trustees the 18th day of May, 1999 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illin0is, the 19th day of May, 1999 vwl/ 5/12/99 5/t 3/99 ORDINANCE NO. 5021 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE VILLAGE OF MOUNT PROSPECT AND GRANTING A CONDITIONAL USE AND VARIATIONS TO PROPERTY COMMONLY KNOWN AS 2107 SOUTH BUSSE ROAD WHEREAS, Vitas Maciukevious (hereinafter referred to as Petitioner), has filed an application to rezone certain property generally located at 2107 South Busse Road (hereinafter referred to as Subject Property); and WHEREAS, the Subject Property is legally described as follows: The West 130 feet of Lot 1 in J-T Builders First Industrial Subdivision, in part of the Southwest ¼ of Section 23, 41 North, Range 11 East of the Third Principal Meridian, according to a plat therof, recorded December 3, 1964 as Document Number 19324462, in Cook County, Illinois; and WHEREAS, Petitioner has requested the Subject Property be rezoned from R-X (Single Family Residence) District to B-3 (Community Shopping) District; and WHEREAS, a public hearing was held on the requests for rezoning, Conditional Use, and Variations being the subject of ZBA Case No. 09-99, before the Zoning Board of Appeals of the Village of Mount Prospect on the 22"d day of Apdl, 1999, pursuant to due and proper notice thereof having been published in the Mount Prospect Journal and Topics on the 7~ day of April, 1999; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered the requests being the subject of ZBA 09-99 and have determined that the best interests of the Village of Mount Prospect would be served by granting said requests. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That the Official Zoning Map of the Village of Mount Prospect, Illinois, as amended, is hereby further amended by reclassifying the property being the subject of this Ordinance from R-X to B-3 (Community Shopping) District. ~: That the President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use, as provided in Section 14.203.F.8 of the Village Code, to allow the reestablishment of an existing service station to be located within the Subject Property. age 2/2 2107 S. SECTION FOUR: That the President and Board of Trustees of the Village of Mount Prospect do hereby grant Variations, as provided in Section 14.203.C.9 of the Village Code, to allow the replacement of a canopy, and reCOnfiguration of a parking lot as shown on the attached Site Plan, prepared by W-T Engineering, Inc., revised April 28, 1999, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A". SECTION FIVE: That the amendments being the subject of this Ordinance are subject to the following conditions: 1. Development of the site shall be in conformance with plans prepared by W-T Engineering, inc. revised April 28, 1999; 2. Add landscaping to the Busse Road and Addison Court frontages to bring the site as close to the required ten foot (10') landscape requirement as possible without compromising on-site circulation; 3. Relocate the proposed dumpster enclosure to the north side of the structure or add landscaping to screen views of the enclosure from the public right-of-way; SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
