ORDINANCE AUTHORIZING THE VILLAGE OF MOUNT PROSPECT TO JOIN THE
INTERGOVERNMENTAL RISK MANAGEMENT AGENCY
WHEREAS, Section 10 of Article VII of the Illinois Constitution of 1970 permits units of
local government/public agencies to contract or otherwise associate among themselves in a manner
not prohibited by law or by ordinance; and
WHEREAS, 5 ILCS 220/1, et seq., entitled the "Intergovernmental Cooperation Act,"
permits public agencies to exercise any power or powers privileges or authority which may be
exercised by such public agency individually to be exercised and enjoyed jointly with any other
public agency in the State; and
WHEREAS, section 6 of the Intergovernmental Cooperation Act, in furtherance of the
provisions contained within Article VII, Section 10 of the Constitution authorizes public agencies to
jointly self -insure and authorize each public agency member of the contract to utilize its funds to
protect wholly or partially, any public agency member of the contract against liability or loss in the
designated insurable area; and
WHEREAS, a number of local governmental agencies have organized themselves into an
intergovernmental joint risk pool known as the Intergovernmental Risk Management Agency and
have executed a Contract and Bylaws for that Agency; and
WHEREAS, the Village of Mount Prospect made application for membership to the
Intergovernmental Risk Management Agency; and
WHEREAS, after diligent review of all issues, including IRMA's Contract and Bylaws,
policies, coverages, membership rights and obligations, contribution calculation, claims
administration services, risk management and training services, grant programs, the overall
operation of IRMA and a review by an independent consultant, the Village of Mount Prospect
has determined that it is in the best interests of the Village to join IRMA; and
WHEREAS, on December 13, 2017, the Board of Directors of the Intergovernmental
Risk Management Agency approved the Village of Mount Prospect for membership into IRMA,
conditioned upon the passage of an Ordinance authorizing the execution of the Contract and
Bylaws by the Village's Chief Executive Officer;
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION 1: The foregoing recitals are adopted as part of this Ordinance.
SECTION 2: The Village of Mount Prospect shall become a member of the
Intergovernmental Risk Management Agency and upon such membership shall be subject to the
terms and provisions of the IRMA Contract and Bylaws, as amended from time to time and the
policies and procedures of the Intergovernmental Risk Management Agency.
SECTION 3: The obligation of the Village of Mount Prospect to fully participate in the
operations of the Intergovernmental Risk Management Agency as defined in the Contract and
Bylaws as amended from time to time and the policies and procedures of the Intergovernmental
Risk Management Agency shall commence on January 1, 2018.
SECTION 4: The Mayor and the Village Clerk are authorized to execute this Ordinance
and deliver a certified copy to IRMA.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage
and approval as provided by law.
PASSED by the Board of Trustees of the Village of Mount Prospect, Illinois, this 19th day of
December, 2017.
