AN ORDINANCE AMENDING CHAPTER 23 (OFFENSES AND MISCELLANEOUS
REGULATIONS), ARTICLE I (OFFENSES), OF THE VILLAGE CODE OF MOUNT

BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
gjECIION I Chapter 23, Article I of the Mount Prospect Village Code is hereby
amended by creating a new Subsection 23.118 entitled "Powdered Alcohol", which shall
read in its entirety as follows
"23.118: Powdered Alcohol
A. For purposes of this section, 'powdered alcohol' means any powder or
crystalline substance containing alcohol, as defined in Section 1-3.01
of the Liquor Control Act of 1934 (235 ILCS 5/1-3.01).
B. No person shall sell, offer for sale, or deliver, receive or purchase for
resale in the village any product consisting of or containing powdered
alcohol."
SECTION 2; -Chapter 23, Article I of the Mount Prospect Village Code is hereby
amended by creating a new Subsection 23.119 entitled "Vaporized Alcohol", which shall
read in its entirety as follows:
"23.119: Alcohol Vaporizers
A. For purposes of this section, an `alcohol vaporizer' means a device
designed, manufactured, marketed or used for the purpose of mixing
alcoholic liquor with oxygen, air or another gas to produce a mist or
vapor for inhalation or snorting for non -medicinal purposes. 'Alcohol
vaporizer' shall not include such medical devices as inhalers,
nebulizers, atomizers or other devices properly prescribed by a
physician and being used to dispense a prescribed medication to the
holder of such prescription.
B. No person shall possess, sell, transfer or use an alcohol vaporizer
within the village.

C. No person shall use a medical device such as an inhaler, nebulizer,
atomizer or other device properly prescribed by a physician for the
purpose of mixing alcoholic liquor with oxygen, air or another gas to
produce a mist or vapor for inhalation or snorting for non -medicinal
purposes within the village.
D. An alcohol vaporizer is subject to immediate seizure by the police
department and destruction, upon order of the Circuit Court."
SECTION 3: Chapter 13, Article IV, Section 13.405 of the Mount Prospect
Village Code is hereby amended by created new Subsection 13.405(G), which
shall read in its entirety as follows:
"G. No licensee shall engage in or allow conduct at a licensed premise
that violates Section 23.118 or Section 23.119 of the Village Code in
regard to powdered alcohol and alcohol vaporizers."
This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner provided by law.
