HomeMy WebLinkAboutOrd 5070 12/21/1999 ORDINANCE NO. 5070 AN ORDINANCE GRANTING AN EXCEPTION FROM THE DEVELOPMENT CODE (CHAPTER 16) FOR PROPERTY LOCATED AT 507 SOUTH WILLE STREET Passed and approved by the President and Board of Trustees the 21st day of December, 1999 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 22nd day of December, 1999 V~NL t210/99 12/13/99 ORDINANCE NO. 5070 AN ORDINANCE GRANTING AN EXCEPTION FROM THE DEVELOPMENT CODE (CHAPTER 16) FOR PROPERTY LOCATED AT 507 SOUTH WILLE STREET WHEREAS, Kevin and Laurie Duffy (hereinafter referred to as Petitioners) are the owners of the property generally located at 307 S. Wille Street (hereinafter referred to as Subject Property) and legally described as follows: On Lot 4 and the North half of Lot 5 in block 7 in Prospect Park Subdivision Number 1, being a subdivision of the West half of the North 60 rods of the Southwest quarter of Section 12, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, the Petitioners have requested an exception to Section 16.403.C.4.a of the Development Code requiring a twenty-foot (20') utility easement along the rear property line to allow for the construction of a garage. WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the request for an exception from Section 16.403.C.4.a of Chapter 16 (Development Code) for the Subject Property at their regular meeting on November 17, 1999, said request being the subject of PC 05-99 and by a unanimous vote recommended to the President and Board of Trustees of the Village to grant the exception from Chapter 16 as requested; and WHEREAS, the Plan Commission has forwarded its recommendation being the subject of PC 05-99 to the President and Board of Trustees of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: An exception to Section 16.403.C.4.a of the Development Code (Chapter 16), requiring a twenty-foot (20') utility easement along the rear property line to allow for the construction of a garage, is hereby granted, as shown on the Site Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A." age 2/2 307 S. Wille SECTION THREE: Except for the exception granted herein, all other requirements of said Development Code shall apply to the subject property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
