HomeMy WebLinkAboutRes 20-17 06/20/2017 Intergovernmental Agreement for Pedestrian Crossing Improvements at Rand/Euclid and Rand/83/Kensington IntersectionsRESOLUTION NO. 20-17 A RESOLUTION AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION (IDOT) FOR PEDESTRIAN CROSSING IMPROVEMENTS AT THE INTERSECTION OF RAND/EUCLID AND THE RAND/IL 83/KENSINGTON INTERSECTIONS, MOUNT PROSPECT, ILLINOIS WHEREAS, the Village of Mount Prospect (the "Village") is a home rule unit of government pursuant to the Illinois Constitution of 1970; and WHEREAS, the provisions of the Intergovernmental Cooperation Act, (5 ILCS 220/1 et seq.,) authorizes and encourages intergovernmental cooperation; and WHEREAS, the Village of Mount Prospect and the Illinois Department of Transportation (IDOT) are units of government within the meaning of the Constitution of the State of Illinois, 1970 Article VII, Section 10, having the power and authority to enter into an intergovernmental agreement; and WHEREAS, the Village's Bicycle Plan and the Rand Road Corridor Study identify the need for pedestrian signals and marked crosswalks at the triangle intersection formed by Rand Road, Elmhurst Road and Kensington Road; and WHEREAS, IDOT identified the intersection of Rand and Euclid and the Rand/IL 83/Kensington intersections as State of Illinois roadways to receive pedestrian crossing improvements in 2017; and WHEREAS, Federal funds from the Highway Safety Improvement Program (HSIP) will cover 90% of the construction and engineering costs and the remaining 10% will be paid proportionally between IDOT and the Village of Mount Prospect; and WHEREAS, the estimated total construction cost for the pedestrian crossing improvements at the intersection of the Rand/IL 83/Kensington intersections is $115,000; $103,500 of this cost will be covered by the HSIP grant, $10,223.50 by IDOT, and the remaining estimated balance of $1,276.50 will be paid by the Village of Mount Prospect; and WHEREAS, the improvements shall include pedestrian signals and marked crosswalks along the east and south legs of the Rand Road and Euclid Avenue intersection and on the outer legs of the triangle area of Rand Road, Elmhurst Road(IL Route 83 and Kensington Road; and WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have deemed that the best interests of the Village will be served by entering into the Intergovernmental Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, PURSUANT TO ITS HOME RULE POWERS: SECTION ONE: The Board of Trustees of the Village of Mount Prospect do hereby authorize and direct the Mayor to execute the Intergovernmental Agreement between the Village of Mount Prospect and the Illinois Department of Transportation (IDOT) for pedestrian crossing improvements at the Rand/Euclid Intersection and the Rand/IL 83/Kensington intersections attached hereto and made a part of this Resolution as Exhibit "A." SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Agoranos ._ Village Clerk AGREEMENT THIS AGREEMENT entered into this day of A.D., by and between the STATE OF ILLINOIS, acting by and through its Department of Transportation, hereinafter called the STATE, and the Village of Mount Prospect, County of Cook, of the State of Illinois, hereinafter called the VILLAGE, WITNESSETH WHEREAS, the STATE, in order to facilitate the free flow of traffic and insure safety to the motoring public as part of the Highway Safety Improvement Program is desirous of improving the existing signalized intersection on US 12 (Rand Rd) by installing pedestrian signal heads and push buttons at the intersection of US 12 (Rand Rd) at IL 83 (Elmhurst Rd) at Kensington Rd (to be known as Job Number C-91-023-17, Section 2016-056TS and Contract No. 62D44) and by performing all other work necessary to complete the improvement in accordance with the plans and specifications; and, WHEREAS, the VILLAGE is desirous of said improvement in that same will be of immediate benefit to the VILLAGE, and permanent in nature; and, WHEREAS, the VILLAGE shares jurisdiction of the following intersection with the STATE at US 12 (Rand Rd) at IL 83 (Elmhurst Rd) at Kensington Rd NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE agrees to prepare plans and specifications, receive bids, award the contract, furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans, specifications, and contract. The STATE also agrees to pay all construction and engineering costs subject to reimbursement by the VILLAGE as hereinafter stipulated. 2. The VILLAGE agrees to approve the plans and specifications by letter or resolution prior to the STATE advertising for the work to be performed hereunder. 3.
