CALL TO ORDER Meeting called to order at 7:04 PM 1.1 ROLL CALL Members present Arlene Juracek, William Grossi, Eleni Hatzis, Paul Hoefert, Richard Rogers, Colleen Saccotelli, Michael Zadel 1.2 PLEDGE OF ALLEGIANCE - The Pledge of Allegiance was led by Trustee Grossi 1.3 INVOCATION - Trustee Hatzis provided the Invocation 2. APPROVAL OF MINUTES 2.1 May 16, 2017 Motion by Michael Zadel, second by Colleen Saccotelli. MAYOR'S REPORT 3.1 Appointment of Mayor Pro -Tem Mayor Juracek stated in accordance with the Village Code, the election of the new President/ProTem would be conducted. Mayor Juracek provided background information and the procedure for the nomination of Mayor Pro Tem. Mayor Juracek stated a Trustee must serve at least one year on the Board before being considered for this role. Mayor Juracek stated Trustee Paul Hoefert is nominated to serve the upcoming term. Mayor Juracek thanked Trustee Saccotelli for her term as Mayor Pro Tem and added she served her time ably. Mayor Juracek moved for the nomination of Trustee Paul Hoefert to serve as Mayor Pro Tem for the term to run July 1, 2017 through June 30, 2018. Mayor Juracek asked for other nominations; there were no other nominations. Motion to close the nominations for Mayor Pro Tem. Motion by William Grossi, second by Richard Rogers. Yea: William Grossi, Eleni Hatzis, Paul Hoefert, Richard Rogers, Colleen Saccotelli, Michael Zadel Final Resolution: Motion Carries 3.2 A Resolution Supporting the 12th Annual National Dump the Pump Day - June 15, 2017 Mayor Juracek presented the Resolution in support of the Village of Mount Prospect's participation in the American Public Transportation Association 12th annual National Dump the Pump Day on June 15, 2017 which encourages people to use public transportation for a day with the hope the experience will turn into a habit. Motion by Richard Rogers, second by Michael Zadel. Yea: William Grossi, Eleni Hatzis, Paul Hoefert, Richard Rogers, Colleen Saccotelli, Michael Zadel Final Resolution: Motion Carries Resolution No. 17-17 3.3 1st Reading of AN ORDINANCE AMENDING CHAPTER 13 (ALCOHOLIC LIQUORS) OF THE VILLAGE CODE OF MOUNT PROSPECT. This ordinance increases the number of Class "P-1" liquor licenses by one (1) Vishva Groups Inc. d/b/a Cardinal Wine & Spirits at 1721 W. Golf Road Village Manager Michael Cassady provided background information stating the applicants have met Village requirements and submitted all required documentation. Village staff met with the proposed new owners of Cardinal Wine and Spirit store, Ms. Jalpaben Patel and her husband Viraj Patel to discuss their request for the creation of a new Class "P-1" liquor license. The Class "P-1" license provides for the retail sales of alcoholic liquors on a package basis. The purchase of the business is contingent upon approval of this license application. In response to a concern from the Board, Ms. Patel assured the Board she and her husband fully understand the Village's regulations regarding the sale of liquor and take the matter very seriously. Motion to waive the rule requiring two readings of an Ordinance increasing the number of Class "P-1" liquor licenses by one (1) Motion by Michael Zadel, second by William Grossi. Yea: William Grossi, Eleni Hatzis, Paul Hoefert, Richard Rogers, Colleen Saccotelli, Michael Zadel Final Resolution: Motion Carries (Consent): 5.1 List of Bills - May 10 - May 30, 2017 Resolution: Approve List of Bills (Consent) 5.2 Motion to adopt an Intergovernmental Agreement with the Village of Arlington Heights for access and use of the Police Department lock-up facility for the period May 2017 -May 2019. The Intergovernmental Agreement with the Village of Arlington Heights permits the Arlington Heights Police Department access to and use of the Mount Prospect Police Department's lock up facility on an interim basis during the construction of the new Arlington Heights Police Station between May 2017 and May 2019. Resolution No. 19-17 (Consent): 5.3 A RESOLUTION REQUESTING CLOSURE OF CERTAIN PORTIONS OF CENTRAL ROAD AND ELMHURST ROAD (ROUTE 83) IN ORDER TO CONDUCT A PARADE This resolution authorizes the Village to request approval from IDOT to close portions of Central Road in order to conduct the annual 4th of July parade. Resolution No. 18-17 (Consent): 5.4 Waive the rule requiring two readings of an ordinance and adopt AN ORDINANCE PERTAINING TO A DETERMINATION OF THE PREVAILING WAGE RATES This ordinance, required by the State of Illinois, adopts the prevailing wages established by the State of Illinois for public works projects provided by contractors. Ordinance No. 6329 6. OLD BUSINESS 6.1 PZ -02 -17 TEXT AMENDMENTS TO CHAPTER 14 AND CHAPTER 9 OF THE VILLAGE CODE {1st reading of an ORDINANCE AMENDING CHAPTER 9, "DEFINITIONS" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS and 2nd reading of an ORDINANCE AMENDING CHAPTER 14, "ZONING" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS} The first reading of this ordinance was presented at the April 18th Village Board meeting. Following a presentation and discussion, the Board decided additional information was needed. The Transportation Safety Commission was called upon to conduct additional studies to determine further action. The second reading was deferred to the June 6, 2017 Village Board meeting. Assistant to the Village Manager Nellie Beckner provided background information stating that questions raised by resident concerns, jump-started the conversations leading staff to examine the subject ordinances. Ms. Beckner presented the report provided by the Transportation Safety Commission following their meeting on May 22, 2017. Staff presented modified amendments to the Transportation Safety Commission. In addition to the amendments to Chapter 14's definition of Sight Triangle, staff presented an added regulation to Article III [General Provisions], Vision Clearance, as well as recommendations to the definition of sight triangle in Chapter 9 [Public Utilities, Pavement and Tree Regulations]. The Transportation Safety Commission raised the following points during discussion: clarification that the regulation of Vision Clearance would only apply to corner lots; that the inclusion of driveways in the regulation would include numerous non - conformities; that the fence regulations would not change. In addition, the TSC wanted to understand the method of enforcement for properties that would be in violation, as they did not want to give the appearance of Mount Prospect "over regulating" properties or burden a property owner with fines, etc. https://www.boarddocs.com/il/vomp/Board.nsf/Public# 2/4 6/21/2017 BoardDocs® Pro The Commission made a recommendation to concur with staff recommendations related to the three code amendments, the motion was approved by a vote of 7-0. Ms. Beckner Drovided the following in resoonse to auestions from the Village Board • Codes will be enforced by resident complaints similar to the enforcement of property maintenance issues. • Shrubs and fences are not considered the same. Fences are considered structures; shrubs and bushes can be molded, shaped and trimmed. • A timetable for compliance does not need to be part of the ordinance; this direction will come from staff who will communicate with residents • The goal is to work with residents until they are complaint; the goal is not to issue tickets. Trustee Saccotelli pointed out a discrepancy in the two draft ordinances. The Ordinance amending Chapter 14 includes a Section 3 which refers to amendments to Chapter 9; this portion should have been included with the Ordinance amending Chapter 9. Ms. Beckner confirmed this was a clerical error made when drafting the ordinances. The Village Clerk stated these discrepancies will be corrected when the final version is submitted to the codifiers and presented to the Mayor for signature. Motion to adopt an Ordinance amending the Zoning Ordinance (Chapter 14) of the Village Code of Mount Prospect as amended by correcting a clerical error on the draft ordinance. NEW BUSINESS None. 8. VILLAGE MANAGER'S REPORT 8.1 MOTION TO WAIVE REQUIREMENTS FOR PUBLIC BIDDING AND AWARD A CONTRACT FOR TURF MOWING IN AN AMOUNT NOT TO EXCEED $55,525. Public Works Director Sean Dorsey provided background information and answered questions from the Board. Mr. Dorsey stated the original contract was awarded to Alvarez Landscape, the lowest bidder at the public bid opening on February 13 ,2017. However, the Village was notified by Alvarez Landscape that they had "underbid" and requested the Village to adjust their bid price or reduce the scope of work. Neither option satisfied the Village and subsequently, Alvarez requested to be released from the contract. A formal written request for their contract to be terminated was submitted by Alvarez. The Village attorney determined this request satisfies Alvarez' contractual obligation. Allscape Contractors, Inc. of Romeoville, Illinois (Allscape), the second lowest bidder from the February 2017 bid opening, was contacted to see if they were still interested in the work. The owner of the company indicated that he was, and could assume the contract within two (2) weeks. A copy of Allscape's bid submittal is attached. Sealed bids for the 2017-2018 turf mowing contract were opened on February 13, 2017. On March 7, 2017, the Village Board awarded the work to the lowest cost bidder, Alvarez Landscape (Alvarez), in an amount not to exceed $50,000 in 2017. Next year's expenditures were to be at bid rates but limited to funds appropriated in the 2018 budget. Staff recommends that the Village Board waive the requirement for public bidding and award a two year contract to Allscape, Incorporated in an amount not to exceed $55,525. Year 2 expenditures will be at bid rates but limited to funds appropriated in the 2018 Budget. Motion by Paul Hoefert, second by Richard Rogers. Mr. Boldt also offered a friendly reminder to residents to be cautious and courteous to all pedestrians, but especially children whose presence is increased during summer. Village Manager Michael Cassady announced Coffee with Council is Saturday, June 10. 10. ADJOURNMENT There being no further business to discuss, Mayor Juracek asked for a motion to adjourn.
