Readck 4th Place $ 25 Award AMEND CH. 13 An Ordinance was presented for second reading that would FRANKIE'S: authorize the creation of a Class "W" liquor license (beer and wine 720 E. RAND ROAD at the dining table only) for Frankie's Fast Food Restaurant CLASS "W" located at 720 East Rand Road. ORD.NO. 4822 Trustee Clowes, seconded by Trustee Skowron, moved for passage of Ordinance No. 4822 AN ORDINANCE AMENDING CHAPTER 13 OF THE VILLAGE CODE Upon roll cell: Ayes: Clowes, Corcoran, Hoefert, Skowron, Wilks Nays: None Motion cerried. A request was presented to authorize the new owner of CLASS "S" FROM Martinelli's Restaurant, located at 1724 West Golf Road, to MARTINELLI'S TO continue operation under the existing Class "S" liquor BELLA CAPRI license. The name of the restaurant will be changed by the 1724 GOLF ROAD new owner to Bella Capri. Trustee Wilks, seconded by Trustee Hoefert, moved to authorize the new owner of the restaurant at 1724 West Golf Road, formerly Martlnelli's and now known as Bella Capri, to continue operation under the existing Class "S" liquor license. Page 2 - September 17, 1996 OLD BUSINESS ZBA 15-CU-95, Text amendment (Commercial Vehicles) An Ordinance was presented for first reading that would amend AMEND CH. 14 the zoning Ordinance, Chapter 14,by establishing a definition for COMMERCIAL commercial vehicles and regulations governing the parking of VEHICLES commercial vehicles in residential districts. The proposed amendment also addresses commercial vehicles operated in conjunction with a home occupation. The zoning Board of Appeals recommended granting these text amendments by a vote of 4-0. Staff had reviewed the recommendations made by Trustee Clowes at the last meeting and presented a memo explaining the rationale behind their response. The recommendation relative to commel~cial vehicles utilized in conjunction with a home occupation has been incorporated into the draft ordinance, placing the same restrictions on those conducting home occupations. The following residents expressed their concerns relative to the proposed Ordinance: Robert Scotese, 911 S. Albert Street Ray Rubio, 412 N. Elmhurst Avenue Clarence Bobikewicz, 1114 Meadow Lane Curt Wosick, 502 S. Elmhurst Road Louis Blatnick, 815 S. See Gwun Some of the opinions expressed were as follows: More commercial vehicles would be parked in driveways if this Ordinance is adopted; Parking a commercial vehicle in the driveway would change the character of a single family neighborhood; Leave the existing law as is and enforce on a complaint basis; Support the proposal to park one commercial vehicle on the driveway; Limit the amount of lettering on a commercial vehicle to 10% coverage. Abide by the recommendation of the Ad Hoc Committee on this subject. Trustee Wilks asked that the proposed Ordinance include previously approved language relative to allowing vehicles with refrigeration units to park in the garage and charge the unit, provided no noise is heard by neighbors. Several members of the Village Board stated that they would support the requirement that commercial vehicles with lettering must be parked in the garage but not on the driveway. This Ordinance will be presented for second reading at the next regular meeting on October 1st. NEW BUSINESS The recommendations of the Safety Commission were presented. At the request of a resident the Safety Commission considered LEONARD LN reducing the speed limit on the 200 block on Leonard Lane from REDUCE SPEED 3(7 MPH to 20 MPH. The Safety Commission recommended LIMIT: 30 TO 20 approval of the request by a vote of 6-0. An Ordinance will be presented for first reading at the next meeting on October 1st. VVEDGEWOOD SUB. The Safety Commission considered a request of a resident to REDUCE SPEED reduce the speed limit on Meadow, Wedgewo0d, Stratford and LIMIT TO 20 MPH Oxford to 20 MPH. The Safety Commission recommended granting the request by e vote of 6-0. Trustee Hoefert, seconded by Trustee Corcoren, moved to concur with the recommendation of the Safety Commission to reduce the speed limit on Meadow, Wedgewood, Stratford and Oxford to 20 MPH. Upon roll cell: Ayes: Clowes, Corcoran, Hoefert, Skowron, Wilks Nays: None Motion carried. An Ordinance will be presented for first reading et the next meeting on October 1st. ALBERT STREET AT The Safety Commission considered the recent recommendation of NORTHWEST HWY staff to widen Albert Street where it intersects with Northwest Highway in order to provide a safer turning radius. Residents in that area wanted parallel parking re-instituted in that area and did not see e benefit to widening the area without providing additional perking. The Safety Commission recommended not to widen Albert Street et Northwest Highway by · vote of 6-0. Trustee Skowron, seconded by Trustee Corcoren, moved to concur with the recommendation of the Safety Commission and not widen Albert Street where it intersects with Northwest Highway. Upon roll cell: Ayes: Clowes, Corcoren, Hoefert, Skowron, Wllks Nays: None Motion cerried. SELL VEHICLES An Ordinance was presented for first reading that would authorize N.W.M.C. AUCTION the sale of specified personal property in conjunction with the Northwest Municipal Conference to take place October 26th at the Mount Prospect Publlo Works Building. Trustee Hoefert, Seconded by Trustee Skowron, moved for passage ORD.NO. 4823 of Ordinance No. 4823 AN ORDINANCE AUTHORIZE THE SALE OF PERSONAL PROPERTY OWNED BY THE VILLAGE Upon roll call: Ayes: Clowes, Corcoran, Hoefert, Skowron, Wilks Nays: None Motion carried. A Resolution was presented that would authorize an agreement IDOT: OPTICOM between the Village and the Illinois Department of Transportation relative to the installation of traffic regulatory pre-emption equipment (Opficom), the cost of which would be shared between the Village and IDOT. Trustee Corcoren, seconded by Trustee Clowes, moved for RES.NO. 25-96 passage of Resolution No. 25-96 A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION Upon roll call: Ayes: Clowes, Corcoran, Hoefert, Skowron, Wilks Nays: None Motion carded. An Ordinance was presented for first reading that would amend AMEND CH.18 Section 18.1404 entitled "Age Limit" which prohibits anyone under the age of 16 from driving. The amendment would "Reserve" Section 18.1404 and would allow anyone under the age of 16 to drive as part of a driver's education program. Trustee Clowes, seconded by Trustee Skowron, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Clowes, Corcoran, Hoefert, Skowron, Wilks Nays: None Motion carded. Trustee Clowes, seconded by Trustee Skowron, moved to concur with the recommendation of the administration and accept the Iow qualified bid submitted by Tom Todd Chevrolet for one 3/4 ton pickup truck with utility body in an amount not to exceed $25,984.30. A request was presented to accept the labor agreement negotiated PUBLIC WORKS between the administration and representatives of. the Public Works LABOR Departmen. t, which agreement is for a 3 year period, through 1999, AGREEMENT and provides for an increase in salaries by 3.4% as well as requiring the employees to pay a higher portion of medical insurance premiums and prescription costs. Trustee Hoefert, seconded by Trustee Corcoran; moved to concur with the recommendation of the administration and accept the labor agreement between the Village and the Public Works Department. Upon roll call: Ayes: Clowes, Corcoran, Hoefert, Skowron, Wilks Nays: None Motion carried, r ~ Mr. Janonis presented a request to ratify his action in authorizing REPAIR FIRE the repair of Fire Engine 512. It was noted that the original ENGINE estimate to repair this vehicle was $9,900.00, however, additional repair was necessary increasing the total amount to $11,899.95. Inasmuch as the total expenditure for this repair exceeds the $t0,000 allowed, it is necessary for the Village BOard to ratify the action of the Village Manager and authorize the expenditure. Trustee Hoefert, seconded by Trustee Corcoran, moved to ratify the action of the Village Manager in authorizing the repair of Fire Engine 512 in the amount of $11,899.95. Upon roll cell: Ayes: Clowes, Corcoren, Hoefert, Skowron, Wilks .Nays: None Motion carried. ANY OTHER BUSINESS Trustee Clowes noted that a recant article in the Sun Times states that the Northern Illinois Planning Commission (NIPC) indicates Mount Prospect and Prospect Heights should not expect a large increase in population. Trustee Clowes stated that there may be new proposals by the Federal Aviation Administration regulations regarding noise and asked that the Village be kept up to date on any such change in regulations.
