SUBJECT: EXTENSION FOR CASE #PZ -38-07 —CONDITIONAL USE & VARIATIONS
309-317 W. PROSPECT AVE. — PAUL SWANSON ASSOC. INC. (APPLICANT)
The Petitioner has requested a fourth extension of the zoning approvals granted by the Village in 2008 for a
Conditional Use Permit and Variations to construct a three -unit rowhome development. The Village most
recently extended the approvals on June 4, 2013. However, the Petitioner has yet to construct the
development due to the current economic downturn. Therefore, the Petitioner is seeking approval to renew
the requests for an additional year.
Attached is a letter from the Petitioner requesting the extension of the Conditional Use and Variation
approvals. As the letter indicates, the Petitioner did not obtain a building permit within the time frame
of the zoning approvals but believes that the residential market has regained enough momentum that
he will begin construction later this year.
Please forward this memorandum and attached letter to the Village Board for their review and
consideration at their May 19th meeting. The Village Board would need to approve a motion to extend
the Conditional Use and Variations granted pursuant to Ordinance #5692. Staff will be present at this
meeting to answer any questions related to this matter.

AN ORDINANCE AMENDING ORDINANCE NO. 5692, AS AMENDED
BY ORDINANCE NO. 6077, GRANTING CONDITIONAL USE PERMIT AND
VARIATIONS FOR PROPERTY LOCATED AT 309-317 WEST PROSPECT AVENUE,
TO APPROVE A SECOND EXTENSION OF THE EFFECTIVE DATE OF THE
CONDITIONAL USE PERMIT AND VARIATIONS
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect, Illinois did adopt Ordinance
No. 5692, ena Conditional Use permit and Variations for Property Located at
309-317 Prospect Avenue at their regular meeting on May 20, 2008; and
WHEREAS, , is requesting a second extension of the zoning
approvals granted by Ordinance No. 5692, as amended by Ordinance No. 6077 by the Mayor and Village
Board at their regular meeting on June 4, 2013; and
WHEREAS, the Petitioner plans to complete the project and is seeking to renew the zoning approvals to
construct the three (3) unit rowhome development, as approved in Ordinance No. 5692; and
WHEREAS, the Mayor and Board of Trustees find that it is in the best interests of the Village to grant the
effective date for Conditional Use permit and Variations.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME
RULE POWERS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the Mayor
and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: Ordinance No. 5692, as amended by Ordinance No. 6077 is hereby amended to extend
the effective date of the Conditional Use permit and Variations to June 4, 2016.
SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval
and publication in pamphlet form in the manner provided by law.

ORDINANCE NO.
AN ORDINANCE PERTAINING TO A DETERMINATION OF
THE PREVAILING WAGE RATES
WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers, mechanics and
other works employed in any public works by the State, County, Village or any other public body or
any political subdivision or by anyone under contract for public works," approved June 26, 1941, as
amended (820 ILCS 130/1); and
WHEREAS, the aforesaid Act requires that the Village of Mount Prospect of Cook County
investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics
and other workers in the locality of said Village of Mount Prospect employed in performing public
works projects for said Village of Mount Prospect.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF
THEIR HOME RULE POWERS:
SECTION ONE: To the extent as required by "An Act regulating wages of laborers, mechanics and
other workmen employed in any public works by the State, County, City or any public body or any
political subdivision or anyone under contract for public works," approved June 26, 1941, as
amended, the general prevailing rate of wages in this locality for laborers, mechanics and other
workers engaged in the construction of public works coming under the jurisdiction of the Village is
hereby ascertained to be the same as the prevailing rate of wages for construction work in the Cook
County areas as determined by the Department of Labor of the State of Illinois as of May 2015, a
copy of which wage rates are on file in the Office of the Village Clerk. The definition of any terms
appearing in this Ordinance, which are also used in the aforesaid Act shall be the same as in said
Act.
SECTION TWO: Nothing herein contained shall be construed to apply said general prevailing rate
of wages as herein ascertain to any work or employment except public works construction of this
Village to the extent required by aforesaid act.
SECTION THREE: The Village Clerk shall publicly post or keep available for inspection by any
interested party in the main office of this Village this determination of such prevailing rate of wages.
SECTION FOUR: The Village Clerk shall mail a copy of this determination to any employer, and to
any association of employees and to any person or association of employees who have filed, or file
their names and addresses, requesting copies of any determination stating the particular rates and
the particular class of workers whose wages will be affected by such rates.

SECTION FIVE: The Village Clerk shall promptly file a certified copy of this determination with both
the Secretary of State and the Department of Labor of the State of Illinois and shall further cause
to be published in a newspaper of general circulation within the Village, a copy of this determination
which shall constitute notice that the determination is effective and that this is the determination of
the Mayor and Board of Trustees of the Village of Mount Prospect.
SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval
and publication in pamphlet form in the manner provided by law.

On July 1, 2012, the Village of Mount Prospect and Hillside Towing entered into a three-
year agreement whereby Hillside Towing would provide towing and storage services for
the Village. The Village entered into the agreement after a competitive bid process was
conducted. Pursuant to the agreement, both the Village and Hillside Towing may
mutually elect to extend the tow agreement twice for periods of one year each. The
Police Department is requesting the extension of this contract for a period of one (1)
year through June 30, 2016, for the following reasons:
1. During the course of the current three-year contract, Hillside Towing Services
has met or exceeded the contract requirements with regard to response time,
towing capabilities, operator expertise, billing practices, storage issues and the
resolution of towing related problems.
2. Over the past three years, Hillside Towing Services has maintained the quality of
its towing services, efficient towing practices, and has maintained its good
standing with the Illinois Commerce Commission.
3. Hillside Towing Services will maintain the currently specified service levels and
fee schedules for the duration of the agreement extension.
Attached for your review is a resolution drafted by the Village Attorney to extend the tow

Attached to this memorandum is a resolution that would grant approval of a renewal of a Class 6b
property tax incentive for Lechner and Sons for their 420 Kingston Court facility in the Kensington
Business Center. The renewal would be for an additional 12 years and would enable Lechner and Sons
to maintain their operations in Mount Prospect.
The Village has granted several Cook County Class 6b tax incentives to attract and retain businesses.
The 6b incentive reduces the assessment level for qualified manufacturing and warehouse/distribution
facilities from 25% to 10% for the first 10 years, 15% for year 11 and 20% in year 12. After year 12, the
assessment level returns to the full 25% for the benefitting property. The 6b incentive can also be
renewed for additional 12 year terms if supported by the Village.
Lechner and Sons currently employs 88 individuals at their facility. They are requesting the Class 6b
abatement to maintain their taxes at around $1.30 per square foot for their property. If the extension
is not granted they estimate that their tax bill would rise to $3.20 per square foot. Similar properties in
nearby Lake and DuPage County range from $1 to $1.50 per square foot.
Please forward this memorandum to the Village Board for their review and consideration at their
meeting on May 19th. Staff will be present at that meeting to further discuss this matter.

Please consider this letter to be a formal request for the Village's support and consent to renew
the 6B assessment designation, and requisite resolution, relative to the above -referenced
property. Unfortunately, changes in the industry, the economy, and other factors beyond their
control, including the significant vacancy of properties similarly situated within the same
subdivision, have made this issue imperative to the continued viability of this facility from an
ongoing cost standpoint.
As you know Lechner & Sons has been a good corporate citizen of the Village for more than a
decade; the Company employs about 88 full-time workers at any given time, as well as several
part-time workers as needed. Employee compensation is consistent with County living wage
requirements; these are not fast-food jobs.
I would be pleased to meet with you at your convenience to discuss this matter. In the meantime,
please schedule such a resolution for a hearing on such a timetable as is convenient for the
Village. Thank you for your consideration.

A RESOLUTION IN SUPPORT OF LECHNER AND SONS,
420 KINGSTON COURT, MOUNT PROSPECT, ILLINOIS,
MAKING APPLICATION FOR AN
EXTENSION OF COOK COUNTY CLASS 6B TAX ABATEMENT
WHEREAS, the Village of Mount Prospect encourages community development to provide
for economic growth and career opportunities; and
WHEREAS, through property tax incentives offered by Cook County, various opportunities
exist for industrial properties in the Village of Mount Prospect, Cook County; and
WHEREAS, without the Cook County property tax incentives, the Village of Mount
Prospect is at a competitive disadvantage with the neighboring counties of Lake and
DuPage in attracting industrial development; and
WHEREAS, LECHNER AND SONS, has requested the Village of Mount Prospect support
its application for Extension of the Class 6B Real Property Classification at 451 Kingston
Court, Mount Prospect, Cook County (Property); and
WHEREAS, the corporate authorities of the Village of Mount Prospect believe that their
request is in the best interest of the economic development in the Village of Mount
Prospect.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

SECTION ONE That the Mayor and Board of Trustees of the Village of Mount Prospect
do hereby support and consent to the application for the Class 6B Renewal from Cook
County for the Property located at 420 Kingston Court and legally described as:
LOT THREE, IN KENSINGTON CENTER-RESUBDIVISION TWENTY-FIVE IN PART OF
THE NORTHEAST QUARTER OF SECTION 35, TOWNSHIP 42 NORTH, RANGE 11
EAST OF THE THIRD PRINCIPAL MERIDIAN ACCORDING TO THE PLAT FILED FOR
RECORD ON FEBRUARY 1, 1989 IN THE OFFICE OF REGISTRAR OF TITLES AS
DOCUMENT T3770802, ALL IN COOK COUNTY, ILLINOIS.

RESOLUTION NO.
A RESOLUTION REQUESTING CLOSURE OF A PORTION
OF CENTRAL ROAD IN ORDER TO CONDUCT A PARADE
WHEREAS, the Village of Mount Prospect desires to hold the annual Independence Day
Parade on a portion of Central Road and Elmhurst Road (Route 83) in the Village of Mount
Prospect on Saturday, July 4, 2015; and
WHEREAS, said parade will require closure of that portion of Central Road between
Northwest Highway and Busse Road, the curb lane of Westbound Central Road between
Busse Road and Arthur Street, and Elmhurst Road (Route 83) between Northwest Highway
and Golf Road; and
WHEREAS, the State of Illinois requires that the Village assume all responsibility and liability
involved in the closure of said State roadways.
NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS A HOME RULE
MUNICIPALITY:
SECTION ONE: That the Village of Mount Prospect hereby requests the State of Illinois,
Highway Department, to close Central Road between Northwest Highway and Busse Road,
the westbound curb lane of Central Road between Busse Road and Arthur Street, and
Elmhurst Road (Route 83) between Northwest Highway and Golf Road between the hours of
1:00 P.M. and 3:00 P.M. in order to conduct the annual July 4th Parade.
SECTION TWO: That the Village of Mount Prospect will assume full responsibility for the
direction, protection and regulation of traffic during the time the detour is in effect and all
liability for damages of any kind occasioned by the closure of the aforementioned roadways.
SECTION THREE: That the Village of Mount Prospect will provide for efficient, all weather
detour signs, to be maintained, conspicuously marked and judiciously patrolled by the Police
Department for the benefit of traffic diverted as a result of the street closure requested herein.
SECTION FOUR: That this Resolution shall be in full force and effect from and after its
passage and approval in the manner provided by law.
